I-757 missed deadline

 I failed to apply for i-757 - Petition to Remove Conditions on Residence when it was initially due. My Green card expired on 01/27/2021. I initially applied for i-90 - replacement of Green Card in Oct, 2020 thinking that was the application required to extend my status. I recently got the denied letter that stated that I should be applying for i-757. My question is - is it too late for me to apply for the removal of conditional status? Does this mean, I will be deported? I am still married to my husband and currently am a mother to a 1 year old baby girl. Please advice.  What should I include in the excuse letter?  Does anyone have a sample excuse letter?

There have been some cases here in VJ of people in your same situation, or similar. Read this thread 

usually. USCIS accepts late filings with a valid reason (medical mostly). Ignorance of immigration is not an excuse. That’s why t the interview or after approval you receive a letter saying that you’ll need to file for ROC later on.

Read the guidelines and submit your package asap. It’s i751 (not i757)

Just got a curious question - the denial letter that I received stated that I should apply for the I-751 application.  The visa extension letter I-797 stated that it will expire on Jan 27th, 2022.  Does this mean I am still going to receive the NTA ?   or Do I have a moment to file I-751 between now till the expiration?

Many Thanks, I spend hours on getting this ready and it will be send out tomorrow.  Included apology letter stating the mistake and affidavit of support from friends  and also included 4 years worth of artifacts in our marriage including baby's pictures.  Is there any hope for us?

Affidavits are weak. Concentrate on quality stuff like bank statements, lease, IRS transcripts, Insurance, 401K.

 

I'd include a copy of the denial letter for I-90 to show that you actually "tried to do something."

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Yes!  I have attached everything I can physically get my hands on - including pictures explaining who's is everyone.  also car insurance and health insurance.

I can’t be either very positive or negative. there is one case that I know of here in VJ where OP was a year late, but she did in a way have compelling reasons: she gave birth and her mother died at the same time, and they had moved around a lot. I think she’s now a citizen.

So I don’t know the answer to your question, but I do know that you have to try first. 
I know the letter sounds really scary. However, deportation is not immediate. It takes years. Another thing to consider is that USCIS cannot strip you of your status: only an IJ judge can. Therefore, in spite of what the letter says, you’re still a permanent resident and have the right to work, until an immigration judge determines otherwise.

Hence file ASAP. Make sure you cover all the Years if your marriage. Sign and date the forms. Make a copy of the whole package before submitting. Keep the receipt with the tracking number. Be proactive.

do not just send the last bank statement. They want to see a continuous financial comingling.
