Hi, guys. 
I know that HIV is not a reason for refusal now.  But how can to avoid RFE or refusal?  We met on a dating site for people living with HIV and we should indicate this in the petition, otherwise it will be a deception. What other difficulties can arise and how to avoid them?  Thanks in advance.

There is no need to conceal how you met.   As with any dating site, you’ll want to print out the TOS to demonstrate that it was not a marriage broker site.

 

HIV was removed from the list of inadmissible medical conditions awhile ago.

The actual requirement is meeting in person in the last 2 years; the form literally asks to describe the circumstances of your in person meeting, so you don't need to go into full detail about the whole relationship.

A simple sentence stating the place(s) and date(s) of your in person meeting(s) that fits into the given field plus the evidence to prove such statement should be enough.

HIV was removed from the list of inadmissible medical conditions awhile ago.

It will be in medical records, I believe they still run blood test with Russian MOM before the visa interview.

My experience was from 2014 and 2016 in Moscow,  as per Internet HIV is  infection no longer requires a waiver for entry into the United States. Good luck immigrating!

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

For those who are immunocompromised (HIV, etc), the following applies at SLEC in Manila (based on our experience in May 2023):

  1. You *will* have to do a sputum test. That's a requirement (even while on a repeat medical) for anyone who's immunocompromised. Also, for expectation setting, it's worth noting that sputum tests may not be immediately available and the wait time for one could be months
  2. Even though being immunocompromised is not a reason for inadmissibility (since 2010), keep in mind that SLEC does see this as a *red flag* and will ask questions if you disclose your status (note - as painstaking as the disclosure may make your case due to the additional sputum testing requirements, I think it's still better than being potentially barred due to omission of this information). In our case, SLEC asked us for a recent CD4 count/viral load exam (even though this is listed nowhere in the requirements, the US Embassy in Manila is apparently asking them to collect this information). We thankfully were able to provide past exam results that were less than 1 year old and these were accepted. Would definitely recommend anyone in a similar position to bring 1) medical exam results confirming a healthy enough CD4 count/viral load & 2) a note from a doctor corroborating these results and affirming that you're in good health
