I applied for advance parole I-131, but I need to travel in the immediate future. What should I do if my advance parole application is still pending?

You only file one I 131

If I were you I would try to expedite your EAD (sounds like your job will continue once you're a PR) and AP along with an emergency AP. 

Why you ask, well because if your job can be done from within the US you can use severe financial loss to expedite the EAD and possibly AP. You will still want to try to get emergency AP as it still might be faster then the expedited.  I would try it all as it really can't hurt.

What I wouldn't do is leave. The way things are shutting down again it may be well over two years before you can get back to the US. That is a long time to not be with your wife and child since you won't be able to visit. She may not want to be a plane with a baby and covid either. 

With covid you can easily tell ppl Zoom meetings only as you have a newborn and will not risk it. PPL everywhere are working remotely you can make it work. 

Indeed I was planning to open an office for my company in the US once approved, so as a consequence if I lose the finances I won't be able to support mysef and family

That's an investment visa. Totally different from B1/B2 /L1. I believe last I checked,  you needed $0.5m. 

 

So is this your company or you work for some company? 

 

Which country is this we are dealing with?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

L1 is intra company transfer, different from EB1 I think what you refer to.

I know and understand that. Read my comment again. If you're planning to open an office, that's considered investment.

You don't file another. You make an Info pass appointment show them proof you need to make a run home to save your business.

Right you need to show them this is a source of income that will continue to support your family stateside. I've never tried this but if you go searching the forums here you may find what others did. I know a job offer letter is used to expedite but you as a business owner should be able to show how you need to be involved in your business which would required your EAD until your AOS is approved.

Emergency Advance Parole Documents

If you are experiencing an extremely urgent situation, you may request an emergency advance parole appointment at your local field office by contacting the USCIS Contact Center. You should bring the following items to your appointment:

  • A completed and signed Form I-131, Application for Travel Document
  • The correct I-131 filing fee
  • Evidence to support the emergency request (e.g. medical documentation, death certificate)
  • Two passport-style photos.

Additional note on emergency AP from uscis:

Business trips, weddings, holiday parties, and other planned events would usually not be considered an emergency situation.

Can you give examples of what is then "emergebcy situation"? for humanitarian or financial loss?

Is it possible to apply for L1 from inside the US while waiting AOS? How long it takes and to which agency is submitted? I assume not USCIS.

Some Examples:

You are here and your family members are in critical condition/hospitalized and you want to go there ASAP.

 

You got a job offer here and losing that offer because of no EAD will cause financial hardship. This is a good reason for EAD expedite.

Your US partner-employer can start the L1 process while you are in the US but since have overstayed your B2 visa, your change of status to L1 will be denied.

 

Everything goes through USCIS within the US.
