SSN for K-1: a problem

Hello,

 

She has entered here Oct 9. We called the Soc Sec office and got an appt for Nov. 30. We were told that all was in order and we get the SSN by mail soon. WE got married in the meantime. We just called the office and found out that they lost our docs and didn't process. They made another appt for Jan 13. But this is outside the I-94 validity. What do we do? 

Is it too late to re-do (Their mistake, anyway)? I don't want to do it through the AOS paperwork due to delays.

It will be too late. It has to be processed before day 75 of the 90 days. Even if it’s their fault, there’s nothing you can do. You have to wait until you receive either an EAD or GC to apply again.

How long does it take to receive either an EAD or GC? Do we request it on the application or go through the SS office again? Also, if it takes more than 4 months, cannot do taxes without a SSN?

8-9 months for EAD, GC depends on your field office, generally 1-2 years

You can request it on the application, it happens that they don’t send it though so you will then go to SSA office and apply in person

You can apply for ITIN instead and use that for tax purposes since you don’t have an SSN yet

….and you don’t qualify for SSN until you have EAD or GC. If you did have either of those in hand then you would qualify for SSN.
