Hi all,

im trying to get my wife a ID/DL. But dmv won’t accept any of my doc. Provided I-94 but to expired end of this month. Got 797C for AOS, married Cert. SSN card. But says cannot do because I-94 will expire within 60 days.
Anyone knows what to do or how to extend I-94

Thread is moved from the K-1 Process forum to the "Moving to the US" forum.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

There is no way to extend an I-94

Not being able to drive for the first 8-10 months is a big drawback to choosing a K-1 over CR-1.  In most states, K-1s cannot drive until they have EAD/AP or green card.  Will be quite a wait for her.

California

AB60 drivers license then.

You will get an instructional drivers permit first which requires an adult passenger with a California drivers license. Then you book a road test appointment which is hard to get.

Makes no difference in California (state of OP) when road test appointments are also 8-10 months out.

Can she get an ID?

She could have received REAL ID state ID within the first 30 days of here entry into the USA.  She would have needed her social security number, I-94, and proof of residency in California.

In my wife’s case we applied for her REAL ID on day 29, and it was issued for a term of 5 years (I was expecting one year).  The DMV would only issue her an AB60 drivers license despite have a valid EAD.

Despite being an LPR and then a citizen, I was only allowed an AB60 until the DMV offered me a free upgrade to REAL ID.

We just went through the CA behind the wheel test with my wife.  (twice 😏🤣)  The key is to check online for appointments often, they open up a few spots here and there at random times with dates in the near future.  Also be very flexible about which DMV office within a hour or two drive you would test at.  For both recent tests In San Diego area we had no problem booking a behind the wheel test within a few days, though at different offices each time.  My wife was CR-1 and had no problem (other than that stop sign she blew through at high speed in DMV parking lot on her first test) but the Chinese girl at the next counter over was refused a license because her visa had less than 60 days on it.

That’s great.  San Diego is an 8 hour drive for us.

Wasn't suggesting that.  Simply that any point in CA that is 8 hours from San Diego, probably has like 20 different DMV offices to chose from within 2 hours.  If flexible on the location and checking often, there are dates in the immediate future.  One could get a drive test in San Francisco  DMV tomorrow.

I arrived to CA in June (Monterey area) went to the DMV in September and applied for AB60 license, took my theory that day and my behind the wheel test the week after.
It’s not a REAL ID, just a Driving license.
Try and go after the I-94 has expired.

Adults who have a driver's license provided by their home country have more time to enjoy driving in California. According to UC Berkeley's International Office, foreign nationals with valid driver's licenses can continue to drive in the state for up to one year.
