I heard rumor that you need to fill AOS within 18 month after you get here, but I might be wrong too.

Yes, you're wrong. There is no limitation on when you have to file AOS.

That said, if you're caught by a ICE or CBP officer while out of status, then you can be deported. The chances of this happening are extremely slim however. Still its a good idea to file for AOS as soon as you can.

We have had this discussion with CBP officers. They look at two things:

1. Legal Entry

2. Fulfillment of the terms of the Entry Visa

Having spoken to the actual officers, we were told to carry:

1. the K1 visa

2. a copy of the marriage cert

Annie carried copies of both.

All of that being said, we filed for AOS just short of a year after we were married and besides getting stuck in the FBI Name Check, we have had no real problems.

For most K-1 visa holders, a brief period of out of status is normal. Almost nobody manages to get married, get their marriage certificate, and get their AOS paperwork together within 90 days of entering the country, it just isn't enough time, so filing a few weeks or months after the 90 day limit is normal and extremely unlike to cause any issues.

Its not "nonchalance", but experience and realism as to how the process works. The fact is that you're probably more likely to get hit by a bus tomorrow than be deported for overstaying a K-1 visa.

With the number of illegals we have in this country, I can't disagree; deportation is highly unlikely. Still, I'd suggest people try to submit their AOS ASAP so they keep completely legal. Once AOS has been filed, one is completely legal again.
