:help: As some of you know my wife came on the K1 visa. We were married within the 90 days but her I-94 expired on March 5th. Her visa has now expired since May 29th. We still haven't filed for AOS!!!! I've posted other threads where people have told me it's ok, just to file ASAP. However, my situation hasn't granted me the extra money to file. I've since changed from that dead market commission job into a nice salary job. I should be able to file very soon. It's just been so hard trying to get us on our feet in this early going.

I need to know if everything is going to be ok now that's she's out of status. Has anyone waited this long to file? Have you heard of someone waiting this long? What's you opinion on this matter?

Also, she has her social security number. We just applied to have her name changed into her married name. The SS office said they needed to verify her documents with USCIS. Do you think they will hold back the issuing of the card because she's out of status now?

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

First of all try to stay calm because you have done everything correctly so far. You were married within the 90 day period so your wife is totally in compliance. There's no real stipulation as to when one should file AOS. Getting back on your feet would be significantly enhanced if you proceed with the AOS process so your wife can also add to the 'cookie jar'. You mentioned the SS# application; seeing that her K1 has expired they might want you to wait until she gets her GC (I am not sure). Bottom line....stay calm because you are good to go my friend. You mentioned 'dead market', were you in the real estate market?

I feel you...this process is very expensive.

However, you should apply before July 30th because the fees are INCREASING.

I wondered what happened to you. Suddenly, you just dropped out of sight. I remember what a ball of nerves we all were last year ! Im happy to see you post, just sorry I can't rightly help you with your question. I would suggest, however, you get busy and beat the fee increase. Oh, and stay in touch, will ya?

Don't just open your mouth and prove yourself a fool....put it in writing.

Yes, you're wrong. There is no limitation on when you have to file AOS.

That said, if you're caught by a ICE or CBP officer while out of status, then you can be deported. The chances of this happening are extremely slim however. Still its a good idea to file for AOS as soon as you can.

Well i was also worried for the same reason till our fellow VJs let me know there is no legal issue.

My I 94 expired on march 9th and the K1 Visa even before that..so been out of statuts for four and half months.

I am about to file my AOS this week.

If you can arrange money to file before the 31st of July, it would help since you will pay almost 400/500USD less in that case..

You do get loan for such small amounts as well though the interest is pretty high but i guess paying of 600/700 usd wont take you a very long time..

I had some experience as a manager so I took a sales manager position for a Home Improvement Company. I'm more responsible for the prospecting department.

It's good to hear from everyone too!! I really enjoyed this site when it was more of a center piece of my life. Well it was my life!! last year was crazy!! glad people don't have to go throught that now!! see yall soon.

Hey Andy - good to see you.

Here's the 'sitch. When an immigrant doesn't file before the K expiration date, they technically fall out of status. BUT if they have married their petitioner, and file to adjust at some point, that out-of-status time is forgiven at the adjustment.

That being said, a K petitioner who has filed to adjust within the 90 days isn't a whole lot better off. They have accumulated no out of status time, but they don't have a defined immigrant status either. You'll read threads around here once in a while where someone asks - "what am I? My K visa has expired but I'm not a permanent resident yet. What am I?"

USCIS calls anyone who has filed but isn't adjudicated yet a 'petitioner to adjust status'. Those who have filed before their visa expires are in a slightly better position than those who haven't, but not much. And that's why everyone maintains not to sweat the situation too much. Just file as soon as you can, and for heavens sake don't let her leave the country.

Ok, at least you acknowledge this Dr LHA. I think why I had problems with your other posts was because I thought you would not acknowledge this. It's never a good idea to be out of status as one is technically an illegal when out of status. But I will acknowledge that USCIS won't prevent you from AoS because of the illegal overstay if the applicant marries a USC.

Couple of days ago came a Request for initial evidence (about things we had sended and will resend)

Nothing about the late filing thank God.
