The OP has been asked numerous times to update their time line and or explain the details so they can better be helped. The failure of the OP to do that should be answer enough I suspect in anyone's mind, no use in speculating what's in the OPs mind if they do not want to clear things up. I mean at this stage in the thread everyone is just guessing. I suppose though the OP if they are reading this thread could glean and piece together what everyone has been saying to answer their question! Besides it's been 12 hours since they last were online here at VJ!

Multiple posts have been removed for digressing from the OP's very specific question.

The OP must return and tell us the beneficiary's country.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

My fiance and i have prepared the k- 1 package ,with plenty of evidence of several visits ,i feel we have solid evidence of a real relationship,.my  question is ,will the age difference play a part in a decision.

It is a common practice especially in the Eastern countries younger ladies to married older men. Main reason is that older men are more established in life and feel more security.

Large age gap usually raises a red flag with USCIS. You will need to present stronger financial documents. History shows that four of our US Presidents had a large age gap, with John Taylor 33 years and Donald Trump 25. I have myself 33 years and had not problem with my petition. My N-400 interview will be in three weeks and I expect no problem.

I’m 20 years older than my husband. My attorney says that is not a consideration in our case. We love each other and just have had to show this is a real marriage.

I would suggest marrying rather than doing the fiance visa, particularly if you are from a high-fraud country or if there are big cultural differences. Fiance visa is taking as long as the marriage visa, and marriage visa has a lot more advantages.

I TOTALLY AGREE 100%….

My husband and I had a 40 years difference and his K-1 was approved without any issue whatsoever.  However, I am told that age difference is always a red flag they do look for.  If you have a strong case, I would not worry about it.

My husband and I are 22 years apart. He’s from The Gambia I’m from the USA. We did the CR1 visa. It took two years but he’s finally here. At the interview they just asked if he wanted kids and he said nah. And the officer said you kids can be complicated. That was it. We never had no problem except for COVID. It took long then we expected.

in our case

Excellent point. That is YOUR case. Age gaps in immigration might or might not be a red flag based on the totality of circumstances, namely country of origin, who is older than who, previous visa applications, etc. Just because your lawyer says that about YOUR case, it doesn’t mean it’s going to be like that for everyone.

They cannot discriminate based on age difference and especially not just because a woman may be older than her husband. As long as your marriage is true and you or your attorney make sure to show proof it will be ok.
