as well as the interview

And sometimes, if the couple has already had a prior interview and their i-751 evidence is compelling, they might not even have an interview at all. So, as @Jorgedighas rightfully said, it is the totality of the circumstances.

You're welcome!

Just a quick note: remember that the evidence needs to cover the whole period of your marriage, not just the last few months.

I am almost ready to send my ROC package. In this post, I share what I sent with my package. Feel free to steal any ideas:

Timeline

I know a case, where the K-1 Husband/Immigrant left and lived with another women. When he found out, he could not adjust, he begged to come back to her, and adjust together. She took him back, and he adjusted. He promptly left, the first wife, and went back to the second one. The son of the K-1 first wife wrote a letter to USCIS about the fraud he committed. Several years later this fraudster went to get his citizenships. It has been 4 years since he applied, he has heard nothing from them, in 4 years. I believe he will not get citizenship, because of the letter the women's son send. It must be laying on file with the citizenship application, and no action is being taken. At this point it has been 5 years since he applied, to become citizen. He is scared to ask or inquire about his citizenship application, thinking he may get in trouble for the past fraud he committed. Here is the best part. He was with this second women, together in Colombia, where they lived together. She also did a K-1 with someone else. This was the plan, she and he, both committed visa fraud, to get and live together in the US.

Not sure how this is related to OPs case.

OP has already adjusted status, there was a separation after she got approved and after they filed jointly for ROC. Now they're getting ready for the interview. Absolutely nothing to do with the case you posted.

Your list is what I submitted with my ROC application back in October 2020. Minus utility bills (everything is under husband's name) and mutual pictures (I forgot to include), plus mortgage statements for the house we purchased together. The I-751 was approved without interview.

My question is, how is the I 751 interview, together or separated?
Or it could also be stoke interview?

Going back to your original question, most likely you will not have a Stokes interview, but it is possible due to your separation with any other red flags with your case. You can prepare for it just in case.  I don’t believe it is likely but it is possible.

Your interview will likely be months from now. Some wait up to two years to get an interview. So yes, updating and collecting additional evidence that you and your spouse live together and share income and expenses will be the most helpful thing to do now. Show you are planning a future together going forward with your spouse, like insurance, co ownership of property, beneficiary of investment accounts and wills health directives. You will have an opportunity to update the evidence you have collected at your interview together so keep building your evidence and submit it at the interview.

It is less important than your evidence you submit but it would not hurt to coordinate answers between you and your spouse in the case of a Stokes interview. Even a normal interview will ask questions about the spouse's birth dates, when you met, anniversary dates, spouses family info, spouses job info, best to get as much of the info correct as possible.

Hello!
I got married in September 2016, got the conditional gc in October 2017.

I got separated from my husband in February 2018 (he moved out of the house) almost got divorce but then reconciled in July 2019 (I moved to him to our current address).

USCIS sent me a RFE and responded with few evidence (since we got separated from most of my conditional gc)

Now is case says is Ready to be Scheduled for Interview. Don’t have a date yet.

My husband and I have more new proofs to show for our interview.

My question is, how is the I 751 interview, together or separated?
Or it could also be stoke interview?

Id love to hear experiences and advices,

Thanks a lot.

Just to add to what others have said. Stokes interviews are not surprise interviews. They happen after a "failed" initial interview. Thus, they are second interviews.

I would focus on the money trail. This is a nice example of evidence you can have ready for the interview. https://www.visajourney.com/forums/topic/699699-i-751-march-2019-filers/ Notice how the applicant explained in full sentences what the evidence submitted is proof of. By doing this, there is no room for interpretation. You have to connect the dots for the officers.

***One last thing, the officer may decide to interview the petitioner or US citizen first. Even if they interview you at different times, that is not a Stokes Interview.

This is the Bible of a joint package! I actually used it as a template for my ROC package, which I'll be sending at the end of this month/ beginning of February. Using this template made it really easy to put the package together. Hopefully in a few years from now, mine can also help somebody else!

LOL, yes, it is literally my bible. I used it as a template for our AOS and I-751. It has worked well so far. :) N-400 window opens up in February and will use it again.

But for N400 I think the documents are less, correct? I mean, at that point you don't have to provide the bona fide of your relationship...

This is what the instructions state. I guess there will be plenty of overlap between the I-751 and N-400. And that is fine. We have copies of our AOS and I-751 filings. No issue there. :)

Evidence that you and your spouse have lived in marital union for at least 3 years at the time you file your Form N-400. Such evidence may include:

(a)  Joint bank and credit card statements;

(b)  Leases or mortgages;

(c)  Birth certificates of children;

(d)  Insurance policies; and

(e)  Internal Revenue Service (IRS)-certified copies of the income tax forms that you and your spouse filed for

the past 3 years (or an IRS tax return transcript for the last 3 years).

I'm rolling my eyes and thinking "here we go again!" lol. Yeah, we also saved our package from AOS (actually we used some of the documents we had in there for our ROC package, too!) and I will make a copy of the ROC package before sending it.
