Getting a divorce during Conditional Visa

I honestly thought that if you are talking about divorce and are honest at the AOS interview, since it is a marriage- based one, the green card would be denied. It seems to me that OP is pretty much on the way to getting a divorce. Wouldn't that represent fraud? Even if they approve him now and they divorce shortly thereafter, during ROC they might get extra scrutiny due to the closeness of the dates between approval and divorce, no?

I forget the Matter, probably the interviewer will not know the Matter. Well I certainly would not assume so.

 

So the likely consequence is a long interview and we will get back to you?

 

Maybe another interview?

 

Essentially there was a case that said as long as the marriage was entered to in good faith and the USC still wishes to sponsor then adjustment is possible.

 

We do not see it very often as the USC would normally wish to back out due to the financial obligations.

Let me give you an honest answer from my perspective.  Go get the interview,get the greencard and let the rest worry for itself. Your focus now is getting the interview. As of marriage, it may or may not work later. What us important now is you having that green card. Two years is alot to explore your options (meaning before your greencard expire, you must have know what works best for you). Many people are confused with your post because you mix up. Advise.., if I am in your situation I will let 2 years from now take care of itself. You guys might think your marriage isn't working now but ones you leave the inertviews things change.
