Hello Everyone,  

 

I’m new to the group here. My partner and I are new to this K1 visa process and this is my first time posting on a forum like this. If possible, I was hoping someone could please provide some additional advice.

 

I sent our I-129F application on 12/14/21. About it week later it was sent back to me on due to a missing signature in part 5 6a. This was a mistake on my behalf for missing. Outside of this mistake, I believe we have everything we need according to the checklist. I was hoping to resend the same application that we used but was wondering if this will still be accepted because each page is stamped at the bottom.

 

If it’s best for us to re-print everything and resend it, would be acceptable for partner who is overseas to use the copies of her translated birth certificate forms?


In reviewing further, I also realized that each of our letters of intent to marry do not have a subject line which states “letter of intent to marry”. Although the content of the letter is indicated, does the subject line need to be included? 

 

My last question is, if we ended up needing just rewrite the letters of intent to marry, do we need to have hand written signature or can it be an electronic signature made on the computer or iPad?

were you sent an RFE or was the petition rejected? How did you pay? Was payment returned?

Photo copies of the statements with the real signatures signed in ink are expected.

You can resend the forms and documents that they sent back, just use new documents for those you are updating.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

I appreciate you taking the time to respond. The petition was rejected and not considered as properly filed. In addition to the entire petition package being sent back, the check I wrote for the filing fee was returned. I received a I-797C form to ensure the signature block is signed. There was also another document included which stated that I can resubmit the petition as a new filing.

 

Regarding the copies, I was referring to my partners translated birth certificate. I wasn’t sure if she would have to obtain a new translated birth certificate document, since the translated birth certificate that we included in the petition was sent back with a stamp at the bottom.

 

Thank you for also clarifying the my question regarding the signature.

I’d submit a new I-129F

You have submitted a photo copy of the translation.  Since it doesn’t appear to made a copy of what you sent (make a copy this time), scan the translations you have and use an image editor to remove the stamps.

We have used our same translated marriage certificate for 14 years.  You should have submitted a copy anyway and presented the original translation at interview(s)

Ditto for the birth certificate and any other translated documents.  They keep originals if you send originals in.

Make a new copy and send it back or send in what you originally submitted.  If it was translated correctly no need to make a new one.
