As I understand it, you only need to show that your most recent year's income was above the poverty level, and that the job you currently hold will allow this year's income to be above the poverty level, too. is it necessary to show longevity in a job?

I just got off the phone with USCIS about the affidavit of support. he told me you should have been at your job for 1+ years to show proof of this. i've read conflicting information here on VJ (spoke to people about success stories who applied with jobs for less than a few months even!) did i speak to someone from the "misinformation line"? lol

a co-sponsor is really not an option for me and i'm running out of ideas here. i was at my last job less than a year, and when i get a new job, will likely be at that job less than a year by the time i apply for AOS as well. if i am above the poverty line (which i am), will i still be okay for applying for AOS or is it necessary to have a co-sponsor! :( help!!!!!!!!!!

Generally the requirement is that you show them last year's tax return only, and that should show you're over the poverty limit. If last year's tax return doesn't show that then the burden of proof on you that you are above the poverty line becomes more difficult.

That said, the misinformation line strikes again: There is no requirement that you have to prove you have been in your job for over a year.

I have the same problem - for the past 3 years my wife has only been working 3-6 months a year (then she would travel back to europe to spend time with me) in USA and so her tax returns show only around 10k earned a year which is below poverty line. She came back last september to usa, got a job and for this year she already is well passed the 125% of poverty line rule that has to be met. She has all the papers to prove that ofcours and on top of that she has savings.

The question is: what realy counts for the application to be accepted, this years anual income or the past 3 years ?

What really counts is "the totality of the circumstances". There is no one silver bullet.
