Hello everyone,

 

so much has happened since submitting my K1 application in February 2020 I am not sure what information I should provide for my question below so I'll keep it simple for now and provide any additional details in responses.

 

My NOA2 is Aug 2020 and since then, like many other people I've been waiting to be contacted by the NVC for an interview. I happened to check the website where you schedule interviews, https://cgifederal.secure.force.com/applicanthome, and they had some availability! I scheduled an interview but remembered that my case was still 'at NVC'. my question is - can we still go through with the interview or do we absolutely have to wait for the NVC to communicate with us first?

No, you cannot. Your file isn’t even at the consulate! It’s at the NVC waiting to be sent to the consulate. Please cancel that appointment so someone else who actually is eligible to schedule an appointment can take that spot and it won’t go to waste.

Why would you be waiting to contacted by the NVC to schedule your interview for the K1 visa?

 

It's my understanding that K1 visa applicants must schedule their own interview date...........nobody will do it for you, and it can't be set without the completed DS160 so I don't know how you would have been able to setup a date without it.

 

Strange........something sounds odd

I have heard both of these things from different people. My Lawyer whom helped me with this process suggests I get the medical because I have an interview. However I have heard that I should wait for the case status to change because they are scheduling interviews for us (which I thought was due to backlog from the pandemic).

 

Fyi my ds160 is all set. Basically everything is good to go, was just waiting on the nvc to email us when I happened upon an open interview slot.

 

I am trying to figure out what the right move is because I really don't want to spend money for another medical just to have it go to waste again.

Yes. They schedule their own interviews. AFTER the status shows “Ready”, meaning the case was sent from NVC to the consulate. NOT when it’s still sitting at NVC and the consulate has NOT requested her file yet.

The right move (and the only move) is to wait until the status shows ‘Ready’. You will be wasting your time and money if it’s still sitting at NVC. The consulate has clearly not requested your case and thus it cannot be processed. How do you imagine the interview will go if they do not have your immigration file and do not have any information on you?

I understand. It's frustrating to hear multiple things, especially from people who I expect to guide  and know what the pocess is (my Lawyer).

This was an unnecessary and condescending question. I fully understand the point and implications of interviewing when things aren't ready. 

 

I appreciate all of the information provided by everyone. I'll cancel the interview to make way for others.

I was trying to help you. If you thought my rhetorical question was unnecessary and condescending, well that’s your interpretation. I wish you luck with the process.

But...you initially made the appointment when the case was at NVC, which would mean you didn't understand the implications until it was pointed out.

 

I totally understand why you did it.  It's been a loooonng wait and when it seems your case was making progress it seems you need to keep waiting, which is frustrating.  You were probably hoping that somehow by making the appointment it would force the case to move forward.  It was pointed out that is was not the case, and yet you stated you are trying to "figure out the right move", until it had to be made obvious why the interview needed to be cancelled.

 

Sometimes what is obvious is not obvious until stated.  

 

I am not sure about your lawyer's advise.  Perhaps he/she has clients in other countries where the wait from for the NVC to send the case to the embassy is only 2-3 months.  Therefore it is relatively low risk to get the medical done now and anticipate an interview soon.  This is generally the case for Ukraine (about 2-3 months at NVC) but from what I understand in the Philippines it's 6+ months due to the backlog of cases.  Or your lawyer is not as competent as you hope.  We have seen many posts here from people who stated their lawyer made mistakes and given bad advice.

 

Good luck on your immigration, and I hope your case progresses soon.  There are many more steps after getting the K1 and I hope you stick with VJ to get some guidance.  Perhaps you can get enough information to adjust status without a lawyer.

This is a fair point. You are right that I made the appointment partially hoping that would be the case though if it were that easy, I guess everyone would be doing it. I think what I meant was I understand how very particular this process is and that if something isn't proper, there isn't much if any flexibility. The part I didn't understand was what powerpuff clarified in the first post but then another post stating something else I had heard from others, including my lawyer, made it less clear again which may have frustrated me more and put me back to square one. This process has been a nightmare for me and probably everyone else. Navigating it with misinformation makes it that much worse. I will certainly check the guidance provided here as well, thanks for mentioning that.

You schedule your interview once your status says In-Transit or Ready your case needs to be at the consulate on your interview date or they won't interview you.
