Hello all and hope you having a good holiday ,

 

NVC rejected my I 864EZ saying that "I do not qualify to use it " .

they asking me to use I 864 instead , my question is how should I do It ?

I have a 5 years old son who is already a US citizen (got him that while back home through consulate) but my wife (his mom) is not and I am petitioning for her . do I need two separate I 864 forms for each (my son & wife) or just my wife ? also how long it takes for them to review again documents resubmited ?

hope my questions are clear as I am too confused already .

Your son is a US citizen.  He neither needs an I-864 or a visa.  He needs his US passport.

 

For your wife, you will need an I-864.  Did you indicate that she would be immigrating with your son?  If yes, then that was a mistake since your son as a US citizen would not be immigrating to the US.  

 

Do as asked.  File the I-864.  Don't list assets if your income is sufficient.  It's not much more work than the I-864EZ.

I believe I entered him when form required to enter household size ,that about it . also the form asks if you have dependent and he is .

so basicaly , my son's name and info shouldnt be included anywhere on the form I am sending ,i am I underestanding you right ?

please advice .

I did entered him as 1 when form required to enter household size ,that about it . also the form asks if you have dependent and he is .

I believe it has to do with my income , last year my income was only 1OK due to loss of job with covid but my current is 41 K for this year and sent NVC proof of that as well .

please advise .

did yours go through after submitting the I 864 ( without joint sponsor ) ? if yes how long they take to update  to accepted after resubmiting ?

Yes, it's the 10K last year's income that disqualified you.  You need to be qualifying based on W2 income to use the I-864EZ.  Just put the same information on the I-864 and submit it with the same supplemental documentation.

 

Note that even though your current income qualifies, you don't have  a W2 for that yet.  Just do as they ask.

finally NVC accepted my documents but sent me this FE review note : "This case does not meet the minimum income requirement to sponsor the intending immigrants. To avoid delays, an additional Affidavit of Support Form I-864 from a joint sponsor may be submitted. For more information visit https://nvc.state.gov/aos. The consular officer will make a decision regarding this requirement at the time of the interview. For more information, please visit https://www.uscis.gov/i-864p."

what do I need to do now ? 

(I just got a new job last month and now make 70K) 

please advise

If there has been a big change in your income, complete and upload an updated I-864 (not I-864EZ as you have no qualifying W2) stating your new current 70k income.

is that going to hold my case another 3 months for NVC to approve again ?

BTW , I got another email  from them said they working with US consular abroad to schedule an interview.
