L1B to L1A Approved but something is odd with dates - Help

Hi,

Quick question: my l1b to l1a visa case was recently approved. However de “validity date from” is equal to “validity date to”. Has anyone seen this before? Do you think it is a mistake or it is a “hidden” denial? Attaching the document.

thanks for your help!!

Thanks Coco8 My L1B Max Date was April 2021.  I applied for the extension/conversion  on February and I got the approval in October (I was on the 240 days grace period). I haven’t been able to work because of this error. And my lawyers say that they are not sure of this is an error. Annoying!

Can they re-apply for an extension?

Did the April 2021 L1B validity date max out your 5 years in L1B status?  ( I'm assuming it did and that's why they applied to change your status to L1A, which allows for up to 7 years).  If so, it seems liIe USCIS determined they could not aprove an extension of status beyond that date, because you no longer qualified for that status; but, a change of status without an extension of that status results in exactly what your received -- a change of status that has aleady expired.  Seems like a Catch-22.  I'd have a serious discussion with the company lawyers as quickly as posdible.

Thanks Jan22. I really appreciate your respose.

Yes - it did max out. But the part I don’t understand is why did they approved it instead of denying it.

I will talk to my lawyers, bit do you think they can do anything?

They could apply for a green card? They could also apply for an H1B visa but that's going to take months, because the quota for the year is full. I don't see how either option would allow you to start working right away.

I'm surprised they didn't do anything back when you got this notification, to be honest. Your company should push them to do something or change lawyers. My partner had an L1B, he had the extension up to 5 years, and they applied for his green card well in advance so that he'd have it when it was over.

Yes, thanks Coco8. My i140 is already approved and I took my fingerprints already . I am expecting my EAD (applied on june21)  to come soon. But in the meantime I cannot work.

That's great then!

Yes, it sucks that you cannot work in the meantime.
