Hello Everyone,

 

I was forced to file 2020 tax as MFS, since my spouse did not have either Itin or SSN. Now she got SSN and  I'd like to amend my 2020 tax return that has been already accepted to change filing status to MFJ.

 

 

I'm working on 1040X form. Also, I Wondering if we get the missing stimulus payments we missed in 2020? If so how can we do that?

Here's what I found at the IRS:

If you must file an amended return to claim the Recovery Rebate Credit, use the worksheet on page 59 of the 2020 instructions for Form 1040 and Form 1040-SR PDF to determine the amount of your credit. Enter the amount on the Refundable Credits section of the 1040-X and include "Recovery Rebate Credit" in the Explanation of Changes section.

Even if you are filing an amendment for 2020, you cannot claim the 2020 stimulus checks for your spouse if her SSN was issued after April 2021.  More details from @Wuozopo from my thread on a similar topic --

You should prepare a brand new 2020 tax return filing MFJ to use as a reference for the numbers requested on the 1040X column C. Remember MFJ will require reporting any income she had in 2020 in her home country.  Learn about the Foreign Earned Income Exclusion (Form 2555) so you won’t be taxed on that money. 
 

According to the IRS, stimulus payments are only available for her if she had a SSN by the 2020 filing deadline (April 2021) or if you filed an extension, then a SSN prior to that deadline of October 2021.
