I recently relocated to the US 4 months ago for work and am in the process of filing for an IR-1 for my husband.

At his consular interview my I-864 was rejected because my 2020 tax return does not show an US-based income. However, I did file taxes in 2020 with a foreign tax exemption noting a salary that is over the required 125% poverty line. My expected income for 2021-2022 is also well above this amount, yet they are asking for an I-864 from a joint sponsor.

I assume the I-864 was rejected because "expected income" is not the same as W-2 recorded income and my 2020 tax return gives an adjusted income of $0.00. Does my 2020 the foreign income not count?

Foreign income does not count for immigration

Do as NVC asks or the case will go no further

 

u have only 4 months of income in the US 

u can send a letter from employer stating current salary and start dates to help show US income but 4 months of 2021 isn't enough 

get the joint sponsor

Ok, thanks for the replies.

Yes, I supplied all the documentation of my current income which is $57,000 with a report of the annual salary and my pay stubs. They also have the offer letter from the company.

The officer also told him that I would need to show assets/financial records of $50,000, which I have never heard before.

Will a joint sponsor with a 2020 tax return showing an annual salary of over the $21,775 be sufficient?

Your current income may be too new for them to give great weight in evaluating the I-864.

If a couple's income is short of the 125% poverty line, then they can use 3x the assets to meet the I-864 requirements.

 

How much over are we talking about for the Joint Sponsor?  Barely or a lot over?  That makes a difference.  Also, are there other people that the JS has as household members?

The country makes a difference.  In most Consulates, current income is king.  In Mumbai, for example, they want three years of qualifying past income.  Your profile is incomplete.  If you want meaningful advice, at least tell us what country your spouse is coming from.

 

If your potential joint sponsor has a spouse, child, or other actual dependent, yes the household is three.  A roommate would not be a household member in this context.

Are they asking you to show proof of assets of $50,000 AND provide a joint sponsor 

or are they giving you a choice? 

Your post is very confusing. 

Where did you spouse interview?
