Canadian citizen married to American green card holder

Hi,

i wanted to seek some guidance on my situation. So I am a Canadian citizen married to an American green card holder. He’s suppose to be getting his interview for citizenship soon as he had to reschedule it due to an error.

I am wondering what would be the best way for me to be able to get a work permit in the USA. Should I apply for jobs and see if I get a tn visa (I am a policy analyst)? Should we apply now for my sponsorship or wait till he gets his passport?

You can certainly try for a TN.

Your LPR husband can file an I-130 for you.  He can upgrade the case when he becomes a US citizen.

The wait is long so better to get in line as soon as possible by filing the I-130.

It will take a couple of years either way, due to backlogs and wait times for petition approvals.

If my spouse puts in a petition and I also go for a TN visa won’t I be rejected for the TN considering that my name may show up in the system?

It's possible to get a TN visa even with a pending I-130 petition if you can prove that you intend to return to Canada to pursue your spouse visa.  Check this thread --
