Is your case received by USCIS around May? Do you have any updates on yours? Mine is already 6 mos with them and no updates whatsoever. 😔

Yes, they received my case in early May 2022 and since then no updates whatsoever. They misspelled my name so I submitted a request to fix the typographical error and they replied in July that they changed it. Other than that no news. Not even an RFE. I am starting to worry because normally USCIS is relatively quick to forward it to DOS from previous cases, it doesn't take more than 4-5 months. So I don't know what's happening. When did you send yours? did you get an RFE

Mine as well early May… I had to change address as well and they had fixed that already. That’s true. Most people I know that submitted had their cases on hold around 4 - 5 mos. What’s the nature of your case? Do you have govt funding?

For those that don’t have government funding why did you go the hardship road?

I had the “wrong” impression that the majority of hardship cases had government funding involved.

To answer your question, I guess, one common reason that people go this route is, for cases when they can not obtain a no objection, while they do have a strong hardship case.

What really bufles me, though, is that even after the USCIS finds an exceptional hardship and forwards the I-612/613s to the DOS, the sponsors may still reject. I though that USCIS's finding should be sufficient.

The ECFMG sponsored J-1 physicians are not allowed to go the no objection route even though they’re not funded. That’s the most common reason why we go through hardship or other weird routes.

The average processing time in USCIS is 10 months per https://egov.uscis.gov/processing-times/

That’s true. But for the past few years when the processing times of USCIS is 11.5 mos. or more, it only took them 4 - 5 mos. to decide if you have RFE or you don’t have. This timeline though was evident for those who don't have gov’t funding.

It was from USCIS and they have a form on their website where you can fill it out the correct name and send it online.

I know but usually they never use all the processing time as mentioned above. They forward it to DOS within 4-5 months . This is based on the cases that I have seen before. The big delay is at the DOS but it seems now that even USCIS is starting to slow things down. :(

I totally agree! Do you have govt funding?

No, I do not have. We took this hardship route basically because I am on the skills list and our country does not approve NOS applications.

You’re lucky then but I still don’t understand why is USCIS taking long then in your case? They usually say people with no government funding get their case forwarded faster. Interesting
