My case was pending since Aug 2022 with DOS.

I filed a writ of mandamus in Nov 2023. Court issued summons on Nov 4 and per my lawyer they were sent on Nov 9, but the USPS delay caused them to be served on Nov 27.
Meanwhile, on Nov 8 I received an email from DOS to send all the application material again via email  including the receipt 3035. ( already sent with original application)
Only reaction from DOS has been an email on Dec 20 stating that they have received the 3035( as a response to my email reply on Nov 9).
My online status still says pending due to requested documents.

I am not sure how much longer they will take but my entire life is at stake.

Why would they ask for everything again!! Can you share a screenshot of your case from DOS website? If they had everything why ask again. Are they trying to see if your circumstances have changed since Aug 2022? Because imo when we file hardship we are in a different situation than after two years of it

@Hocus Unfortunately I think DOS lost your document. Is the email from someone named SimsJ as well?
You don't need to update anything, just send a copy of everything you submitted earlier.

Congrats! it should not take too long from this point on, maybe a week or two. Did you receive US gov funding? were sponsor views requested?

Great. Congrats!!!

If you dont mind, why was you NOS denied? Was there a sponsor involved? Also what is that DOS case number document? This is the first time I see it.

My NOS was denied because my country's guidelines were changed prior my application.

My lawyer filed my hardship and they were the one who turned this in to DOS so they just sent me the case number for me to check any updates on my end.

I'm assuming your NOS has sponsor views, but since it was denied, they didn't request sponsor views again for your hardship waiver? is that correct?

Do you think my lawyer should have identified that DS3035 is missing?

We filed it but it didn’t say that it was uploaded. It was sent to DOS in Feb 2022 at the time of initial filing.
Now we sent it as an attachment to email which was sent by DOS as an inquiry.
DOS replied on Dec 20 that they have received it but nothing is updated online.
Could I have saved time if my lawyer identified it ? Do you think they will start my time from the day the DS3035 is changed to received?
