Congratulations. The nightmare is over for you. Can you please tell when you sent the case to USCIS and when your I-612/I-613 were forwarded to DOS?

I filed my case with USCIS on October, 2021. And you can see my timeline when the form 612-613 was forwarded to DOS.

Hello guys, I have a question regarding the timeline. My lawyer submitted all the documents at the same time to both USCIS and DOS. USCIS sent receipt notice in October 2022, but DOS says they got their stuff in Feb 2023. It's still pending in USCIS so obviously there is no I-612 yet.

My question is, I see that DOS shows in all cases as if they have received the I-612 like at the same day, or a few days later, maybe a few months. Is this what they always do? Like if my case hopefully gets forwarded to DOS in the next few months, will it be listed around the same date when they got my other stuff? I'm confused .

Thank you all!

I submitted my case to USCIS and DOS in October 2021 and DOS shows document received in February 2022. So they are following the same pattern even after one year like in your case.

For the next step, USCIS forwarded documents to DOS in March 2022 but DOS showed them as received in August 2022. I am still pending.

The recent approval in this group has exactly same timeline as mine and got a decision. So it's very random process. Each case is treated differently. No patterns can be drawn.

Hello Everyone,

I'm currently 16 months into waiting for my DOS process [original filing October 2021], and my J-1 visa is set to expire in just two months. I'm considering requesting an expedited process based on humanitarian reasons.

Could anyone clarify whether the humanitarian reasons should pertain to a the U.S. citizen or the applicant? Any insights would be greatly appreciated.

Thank you!

I am not entirely sure about this but I would guess that in hardship cases the hardship should be for the US citizen and not the applicant. So I don’t think they care much about the applicant. But again, hardship is complex and when one member of the family is affected you can argue that the whole family is affected. It’s just really difficult to get it expedited through DoS. Are you going to expedite through a congressional inquiry?

Hi Everyone,

I applied for the NOC and got a not-favorable recommendation. The DOS asked for the sponsor's view during my last application. Now I applied for the hardship waiver, will they ask for the sponsor's view again?

There was a similar case as yours a few months ago and the DOS didn't ask for sponsor views again.

hi @Hardship_waiver

Thanks for this reply. I am, actually, in the same situation as @j1_nocwaiver

Do you happen to remember if the case you referred to above was approved in the end?

I think I know what the previous person meant, there was indeed a case in FB group and they applied first for NOS, and it was denied where sponsor views were requested. After they applied for hardship and it was approved and they didn’t seek any sponsor views-so it took actually faster…

I think that person has like 2-3 kids and a spouse so I am sure it was both US spouse and US born kids… so far many cases I saw had kids where the approval happened… I am not quite sure if there is a case where only US spouse present and no kids.

They won’t ask for it… since they already did before, might be a faster process for them and for you!

Hmm humanitarian reasons are tough unless you are from Ukraine where that would totally be considered since there is a war happening… or if you’re from Sudan. But also I think when I googled humanitarian it doesn’t have to be necessarily wars or climatic disasters!! It could also potentially be like a person suffering from disability for instance…

I think you should email DOS and let them know that you waited for like pretty much forever, like 2 years?! And ask if they have any updates I would start there… also it really depends how efficient your senator is, I heard some don’t care and wouldn’t even take extra calls… I think it might depend on the state or willingness of a personnel to help you!

I interview on April 27th, 2023, and the last time my case status was updated at ceac.state.gov was on May 2nd with a status of Application received. Since then, things have continued in this manner. After the interview, I was given a white slip with the locations to pick up my passport and visa in 5–10 days. I've been so concerned since I'm at a loss on what to do. I've contacted the embassy several times via phone and letter and have been advised to wait. Already,  2month is approaching and on cgi portal still stucked on Document delivery information. Please, anyone else is going through this lengthy process? My first class is in the fall of 2023.i am so worried as I donknow what else to do, called and mailed several times but it's not helping.
