Case DQ'ed at NVC and thinking of Tourist Visa due to family emergency and expedite rejected multiple times

Hello all,

 

I have filed for IR5 immigrant visa for my parents from India. And I recently got DQ'ed for both of them. But based on the research and online timelines of lot of people DQ'ed in India the waiting time for interview seems to be almost more than a year at normal scheduling if it works like this. But I have a medical emergency in the states as my wife is pregnant and I tried to expedite multiple times but Embassy/Consulate rejected the request on that grounds. Does anyone have experience for applying for a tourist visa in this situation and is it a good idea to go through that process.

There is no harm in trying.  However, getting a B2 interview could take many months.  It appears Mumbai is accepting emergency appointments only for visitor visas.   Why is this an emergency?  Personally, I think they will just have to wait until their IR-5 appointment is set by NVC.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Emergency as in its our first pregnancy and we do not have anyone by our side to help emotionally, physically during and delivery and after. So we want our parents to be here as the support and as per the information I have Mumbai is backlogged in IR5 interviews and right now they are conducting interviews for DQ'ed cases from June 2020 that is last year. So IR5 interview appointment can take a long time for us as we just got DQ'ed this month.

Good luck.  It might be tough getting the consulate to see this as a real emergency when 2 way video is so common.  You can try, but I would think the chances of success are low.  The only way to know is to give it a shot.

Pregnancy is already being used expedite cases for interviews successfully. A lot of people have been approved for Pregnancy reasons.

Can you please reference me any timeline here if you have it handy or a thread link as well. I would like to get those people opinion on what kind of letter helps in approval.

But, pregnancy is not an emergency....especially normal pregnancy.  Many consulates will accept only emergency cases.

Personally, I think your best chance to have the grandparents around is for your wife to give birth in India.

 

Your wife's pregnancy would not be an emergency if it were your or her case. It certainly isn't an emergency for your parents.

May also sound like you need then for child care, by all means they should try just do not make any plans

I I know people personally who had successfully got expedite approved.
