Hello me as the petitioner submitted my docs to the NVC some were rejected.

 

The main 3 messages I'm concerned about are these 3 messages from the NVC:

 

> Please Submit: The petitioners (myself) I-864 is missing.

 

> Please Submit: The petitioners (myself) 2019 tax return, ( I don't mind submitted this as long as I dont have to sponsor.) 

 

> Please upload (your brother) as a joint sponsor and submit all their documents under their name.

 

My question I would like my brother to be the main sponsor not me. (he lives in a different state)

Am I considered as a sponsor if I fill out I-864? I understand I'm the petitioner but I would like brother to be the main sponsor how can I make this happen?

If you are the petitioner, you are always a sponsor regardless if you have sufficient income, you still have to fill in all the same forms and supply all the same documents, your brother can only be a joint sponsor with you.

  • 14 Jan 2022: Case Status 'Administrative Processing'
  • 18 Jan 2022: Case Status 'Issued'
  • 20 Jan 2022: Passport with visa collected in person
  • 14 Feb 2022: Enter USA via Dulles, airport
  • 29 Apr 2022: Green Card received in Post

 

N-400 Application for Citizenship

  • 16 Nov 2024: Submit N-400 Online and receive receipt notification

You can't.  As the petitioner, you will always be the primary sponsor.  Your brother can be your joint sponsor.  You and your brother each need to submit separate I-864 forms and supporting financial documents, including tax documents.

Timeline

Since you filled out the application and the immigration benefit is through the relationship with you, you are the main sponsor.

Not making the required resources threshold is the reason you need a co-sponsor 

11/17/2016: Got engaged
11/28/2016: I-130 sent to Chicago IL lock box
01/12/2016: NOA1
