How much time do I have to file I-485 after marriage?

Being out of status when the I-485 is submitted has no bearing on the acceptance of the application for processing or on the decision to approve or deny the application.

Accumulated out of status time has consequences should one leave the country and want to get back in, but it has no consequences with respect to the application to adjust status.

There is no "exact answer" anywhere. It's best to file immediately after your marriage. Preferably within the 90 days. But people have done it even up to 6 months after the 90 day deadline. There's no guarantee though.

You're legally out of status after the 90 days. The USCIS has been approving AoS for most applicants, but nothing in the law compels them to approve the application after 90 days. You are legally out of status after the 90 days. There is NO guarantee, despite what anyone claims on USENET or here. Best advice is to get married and file within the 90 days.

I say this having filed late ourselves. My wife's 90 days expired 6/6/07. We filed 7/10/07. I'm not too worried as I expect USCIS to accept our application but I'm under no delusion to assume USCIS absolutely has to accept our application. My wife technically was out of status prior to her AoS submission.

08/13/07 - Received ASC Biometrics Appointment Letter in my home mailbox

08/31/07 - USCIS mailed out Appointment letter with Postmark Date 8/31/07

09/04/07 - Received actual Appointment Letter (Interivew Date 10/30/07)

09/06/07 - Completed Biometrics Appointment at local ASC

10/30/07 - Scheduled AOS Interview Appointment - Approved

08/13/09 - Sent I-751 to CSC

08/17/09 - Receipt date of NOA

09/16/09 - Biometrics

09/17/09 - "Touched"

12/15/09 - Card production ordered

12/17/09 - Approval notice sent

12/21/09 - Received 10-Year GC and Welcome Letter

08/16/10 - Sent N-400 to AZ Lockbox via USPS First Class Mail with Delivery Confirmation

08/24/10 - Check #501 for $675 cleared my account @ 11:20 pm EDT

09/07/10 - Received Biometric RFE dated 9/3/10 -- Fingerprint apt. schedule 10/1/10

10/01/10 - Fingerprint Appointment-- Completed

10/09/10 - Received Interview Appointment Letter dated 10/6/10 for scheduled interview on 11/09/10

11/09/10 - Interview Passed

11/18/10 - Oath Ceremony

My K-2 were out of status for 1 year and 9 months. They just got approved yesterday and we waited 7 mothns for it.

I just advised that if you have a valid reason for not doing AOS on time that is okay. If you see my time line will see some of my reasons.

I waited too long, but was living with the fear of being denied just for the kids being overstayed. I would not recommed anyone to delay the AOS.

04/27/07: Mail I-751 to Vermont

04/30/07: Vermont received I-751 (day 1)

05/03/07: Received confirmation of delivered package

05/25/07: Received BLUE Finger Print Receipt Notification Dated 5/18/07 (day 25)

06/11/07: Received NOA1 dated 5/24/07 (day 42)

06/13/07: Received Biometric Appointment Notice dated 6/8/07 for 06/22/07 (day 44)

06/22/07: Biometric Appointment @ 2:00 Done (day 53)

Touches: 6/22, 6/24 = Status: Case received and pending

10/25/07: Card production ordered on 10/24/07 (day 180)

11/02/07: Received 10 Years Green Card..Done...but you know what is next...lol...(188)
