I'm on tourist visa and get married in US how's the process

she must have trusted someone back home to leave 2 times to visit 

so ,  OP,  do u have a trusted family member to leave your child with while waiting for an interview back home?

While waiting for the immigrant visas for you and your son to be processed, you can use your existing tourist visa to continue visiting your husband. Just don't try to use the tourist visa to live in the US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

These are the basic options (after marriage):

1.  You stay and adjust status.  You will not be able to work or leave the US for 6-8 months.

Your Son's case must be started by your spouse via an I-130.  You son will not be able to join you for 1-2 years.

or

2.  You return to PI while your spouse starts the spousal visa process. 

Your case and your Son's cases are separate, but can be managed so that you both travel together in 1-2 years.

If everybody did this there would be no need for the K-1 Visa. 

 

And I surely would have brought my wife to the US if it was that easy to just Marry her here and apply for the adjustment of status, but instead I followed the process as you are supposed to and we have now been married two years and she is still there in the Philippines

Does she have a tourist visa?

Everyone’s situation and journey is different. We had filed the I-129F, it was approved, and on our first visit in the United States our situation and intentions changed. Just after a month of being together thanks to a visitor visa, we decided to marry and stay together and adjust status. There was no intent to bypass the normal process, we were following it. But given all the things going on in the world, when we decided to marry after being together for several weeks, our intentions changed. In our situation we were already engaged. In others situations, they don’t even meet their fiancé until during a visit. I think the morally important thing is that available avenues are pursued with integrity and honesty.
 

But my readings here tell me that intent is determined at the border by the CBP. If they determine that the intent is to use an issued visa for its correct purpose and then the situation changes, that is what adjustment of status is for. It is unnecessary to have a system that places the burden on the pending immigrant to show that what CBP determined was correct was in fact correct.

I was told that if you are on a tourist visa you can't get married until right before it expires or the day after it does because it will red flag you. You might want to talk to a lawyer before you do this

Because your son is under 21 you are allowed to file his petition the same time you file yours. When you do PLEASE add his name and biological info to your petition as well. That away they will link yall petitions together. An his petition will go through quicker. Good luck 💞

Every post I have seen where somebody raises the issue of looking to enter and adjust using a tourist visa has been shut down pretty quick I know people point out the illegality
