I751 with divorce waiver

Hi everyone.

I applied for I751 joint but me and my ex got divorced recently. I already sent a request letter to USCIS asking to convert my case into a divorce waiver. I also sent a copy of my NOA1 and a copy of a divorce. I didn’t get any divorce certificate, the judge emailed me and my ex only the judgement of dissolution of marriage. And on the email she says that we are divorced. Is that the divorce decree? Or do I have to request for a divorce decree? Thank you

Depends on your state.  Go to the office  of the clerk of court that issued your dissolution and buy at least one certified  copy of your divorce decree.  Then make a photo copy of that and send that to USCIS.  At your interview bring another photo copy plus the original.

I was thinking to email a judge and ask if there is an actual certificate I can get, but thank you for your answer.

The office of the clerk of the court exists for a reason.  A judge is busy.  Good luck with an online only approach … some counties work that way and some don’t.

A judge emailed my lawyer a divorce decree who in turn emailed me the divorce decree.  That was good enough for filing I-129F. And it was useless for the subsequent and related  I-485 interview.  Knowing in advance it would be useless (perhaps because I am gifted with prescience) I went to the county where I divorced and got three certified copies each with the Clerk’s wet seal.  I-485 approved.

Just a quick update for Illinois. I went to the court yesterday to ask for a divorce certificate and I was told that the divorce certificate is the one that judge sent me on the email. There is nothing else that they can give me. Only thing they could do is to make a certified copy of the same document that the judge sent me. They literally just put the stamp on the last page.

Cool.  You’ve a wet stamp now.  This is a certified copy. You are good to go. Never lose this document.

“Certified copy” and certificate are synonyms

Yeah. They asked me how many certified copies do I need, so I got two.

Just a heads up, I needed the decree and the divorce petition. Both can be obtained via the clerk of court
