If you were not expeditiously removed, then you wouldn’t need a waiver. However, the letter does mention the need for a waiver. It might just be a generic letter, but to be on the safer side you could file for FOIA and see what is in your profile.

If you need a waiver you would be informed during your K-1 or CR-1 interview what waiver you needed.

At this point you need to decide if you want to come as a fiance or as a spouse. The spousal visa is cheaper and allows you to work as soon as you arrive and obtain a social security number so it is the most recommended.

I wouldn't worry about the waiver at this point. If you want to pursue the K1 or the Spousal Visa option, get started on it and get in the Que. Don't waste time trying to decipher letters from CBP. If you need a waiver, you have to get all the way thru the interview  stage in either case before you find out if you need a waiver or not. I don't think a waiver is required in this case, it was just a generic form letter printed up.

For many reasons:

 

CR-1s do not need to adjust status.

 

CR-1s are MUCH more likely to be approved in high fraud/high risk countries.

 

CR-1 denials may be appealed.

 

CR-1s are spouses, and therefore relatives.  We saw during COVID that when resources are limited, they are prioritized over K-1s, who do not have a legal relationship to the petitioner.
