K1 visa expiry date confusion

Hi everyone,

 

I have an odd case and I was hoping you can help me in case this has happened before.

 

Due to my K1 visa going into AP for 4 months and me doing the medical a month before my interview, when I was finally got my visa issued it was only valid for 3 weeks (November 16 to December 7). However, the Embassy immigration unit emailed me saying the following:

 

"please note that your visa expiration date will be set to the expiration of your medical examination, which was six months from the date of that exam.  Therefore, your visa will expire on 07-DEC-2021.  If you require additional time to travel to the U.S., then you must get a new medical exam, which will then allow you an another six months validity to your K visa.  If you decide to renew your exam, you may contact the panel physician directly and make an appointment.  If you decide not to get another exam, please ensure you can arrive in the U.S. prior to 07-DEC-2021."

 

I've done a new medical test now which should extend my visa for another 6 months, however my actual visa is technically "Expired" since December 7. I tried emailing them to ask for more details but they refused to give me details and said I should read the email again. 

 

I am traveling to the US end of January 2022 and I am stressing over the fact that my visa is showing expiration date. Has anyone gone through this before?

yes,   the panel physican should send medical results to embassy to mark the passport as such if they still have it

if they don't they should ask for u to return it and i would take passport to embassy gate with copy of the notice and medical if u have it

To clarify my comment, You cannot travel or enter the US using any visa beyond the printed expiration date.  The consulate must re-issue it.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Hi there and thank you for reaching out. What you said makes full sense and its exactly why I am worried. I will definitely email the embassy again as the previous reply from there wasn't helpful at all and made things even more confusing.

Thank you for reaching out JeanneAdil, unfortunately its hard to show up at the embassy without an appointment but I will be sending them an email to explain everything. I'll keep you updated.

I am quite surprised the consulate left out the vital information about re-issuing the visa.  I guarantee you would NOT be allowed to board a flight using a visa with an expiration date in the past.  Good luck in getting this resolved.

It is quite odd as I've had my fiancee and two friends read the email and we couldn't find any details that we might have missed. Anyway, I've emailed them again, fingers crossed they won't be annoyed by me.

Suggested correction to this reply:  I guarantee you would NOT be allowed to board a flight using a visa with an expiration date in the past.

 

OP, be prepared to change your travel plans to a later date, after the visa is re-issued.  With the holidays, it may not be re-issued for a few weeks.

You need to try to get that visa reissued.   Even if you somehow are allowed to board the flight, you will not be admitted to the US with an expired visa.

Thank you for reaching out JeanneAdil, unfortunately its hard to show up at the embassy without an appointment but I will be sending them an email to explain everything. I'll keep you updated.

you don't need to enter the embassy / we know you can't get in

just go to main gate to the guard and tell him you need to give passport to embassy for the new visa attachement

Depending on the country it could be sent back thru sites like Aramex  /  no idea what your country has

keep a copy of the notice and your current visa for own protection

BUT get that passport and the new medical to the embassy as your time is limited

Hi JeanneAdil,

 

I am currently residing in Dubai and going to the capital has some restrictions. We do have services like Aramex and thats how I was requested to send my passport initially (strictly mentioned not to visit the embassy). I also can't send my documents unless requested as per their notice on the appointment website.

 

They still have not responded to my email and I am a bit lost honestly. I did send few weeks back an email asking about the same but they told me "its self-explanatory" which added to the confusion.

Hey Jorgedig,

 

I will be flying from Abu Dhabi airport which has US pre-clearance before boarding the flight and I was hoping I can explain to them based on the emails I received from the Immigration Visa unit chief but I also understand this might not be enough. Problem is, no where in their email have they mentioned that I need to re-send my passport for visa issuance so not sure why they would stamp my visa with such short notice. They haven't replied to my email that I sent on Saturday.

1. fly now before the end of the month

or

2.  cancel the flight till the new visa is issued
