Hello all! newbie here, wishing i knew about this site a year ago.

 

im finalizing my K1 now and im pretty confident I have all the info i need with just a few small questions (i will post below in case anyone cares to answer) I was wondering if there was a service that could review the forms i currently have before submitting them. I considered RapidVisa but have heard its not too useful.

 

2nd, I will be using my parents as a joint sponsor and have heard that i also need to fill out the Affidavit of support, is this true? while i have filled it out just in case i dont really want to send in unnecessary paperwork

 

heres my current questions:

- i have another job that wasnt on my last year's taxes, should i provide proof of it? if so, what is the best proof? I work for Taskrabbit so its freelance

-im trying to submit before the end of the year but i will move (same city) in January. Id rather not have to re-type forms with the new address, is there another way to inform them? should i just change it after submission?

You need to show your income meets the requirements as well as file taxes 

 

You will always be the sponsor

You don't need to submit affidavit of support with the petition, it's required only for the interview which could be up to a year or more from now. So don't worry about it. Just go with the petition.

You have quite a while based on current processing times before the affidavit of support is required. I-129F application is all about intent to marry, proof of meeting, etc. As someone else said, it is not required (for the first time) until the embassy asks for it in their pre-interview checklist letter they send.

 

Review of the I-129F packet before sending, suggest cross checking the required documents on the checklist on USCIS, the sample submission letters here, the Guides on here etc. and just make sure everything that is mandatory is submitted, otherwise a lawyer could check for you the actual forms.

what embassy?

some do not accept joint sponsor

 

u may want to reconsider filing a K1 and go and marry (or meet in another country to marry)

that way the fiancial burden is lessoned as the spouse can work as soon as they enter the US 

and you avoid the AOS long process and expense

 

Please note that some U.S. Embassies may not accept joint sponsors for the K-1 fiance visa (e.g. U.S. Embassy, Manila Philippines) whereas, most U.S. Embassies do accept joint sponsors for the CR-1 spousal visas.

You have more than a year before you need to worry about the affidavit of support (s).  

 

Are you going through Manila?  A year would be enough time for you to get a job that meets the requirements to sponsor an immigrant.  Current income is evidenced through payslips and employer letters, not tax transcripts.

 

Btw, I would definitely not use RapidVisa or another service to look over the petition before sending.  Print out the instructions/checklist for I-129-F on the USCIS.gov site, and use that as a guide.

 

Most important:  evidence of the required one meeting during the previous 2 years.  Best types are passport stamps and boarding passes.  Also:  go through and make sure you've not missed any yes/no type check boxes or signature spots.  Those are easy to miss.

 

And you should both sign and date the joint "intent to marry" letter, or do separate letters.

 

Lack of evidence of the meeting, missed signatures/check boxes, and inadequate intent to marry letters seem to be the main reasons people get RFEs.

Sorry, another thing that I do not believe is required is police records - again, if needed they are requested as part of the communication from the Embassy when your interview is ready to be scheduled. And I think they expire depending on the country, so not sure I would waste time or money to get them now.

If OP answered yes to Part 3, item 4a, copies of police records are not required, however, information on the arrest or conviction is required, such as dates, outcome of the case, etc., so that is most likely why he/she is waiting for the police report before completing the petition.  OP is presumably a US citizen as the petitioner, so the country is USA and they will do a background check at USCIS and find the arrest/conviction on record.  The main thing with these situations is therefore to be honest.  We have seen cases where the petitioner did not include the arrest/conviction on the I-129F and this caused problems later in the process.

@carmel34 yes sorry I did not think of that but you are correct.

yeah i read somewhere that its best to just include the police records and explain later. both were very minor and i was ever charged.

 

as for the financial issue, not being able to use a joint sponsor is concerning. i definitely make more money now than my taxes show a year before. But my brother basically went through a similar situation and was much more poor and still got a approved so lets hope it works out

Some people will need to get two jobs, or improve their employment outlook with additional education, etc.  100/125% of the FPL is quite low, and not enough for two people to live on in most parts of the US.

Everyone's situation is adjudicated based on their unique totality of circumstances.  The income guidelines are simply guidelines.  COs can deny/request joint sponsors even in cases where the petitioner earns well above the FPL.

 

At this point, you have time to plan and make life changes to improve your chances.  I also strongly recommend coming up with a plan for providing health insurance for the intending immigrant, since she won't be eligible for any public programs.

It does not matter, you will always be the primary sponsor. You must fill out your own affidavit of support and send supporting documents, regardless of your income.
