That’s what I just explained, mismatched in divorce date. 2nd time is this topic of discussion, no letter issued by embassy and no reason given

You might not be getting the full story (from your son as he is most likely summarizing his future wife's story and might have omitted something important). 

First interview can impact second interview.They might have seen something in the first interview notes that caused the cancellation of the K1 visa.

Usually VJ suggests people get married after first K1 refusal.

Another member from Cambodia has just experienced the same as your son. 2 K1s refused so they are going to get married.

Yes, but shouldn’t the embassy issue a refusal letter to her instead of issuing a visa and put s Cancelled Without Prejudice stamp on it? Is it possible that there’re missing document like one of VJ’s members stated in one of the replies? I.e. health examination report, which she did only a few days before going to the interview

There is a chance there is some missing paperwork. 

Was she given a 221G?

If they had not returned the passport it could be possible they made a mistake with the visa and need to print another one. 

It could also be the old K1 visa wasn't closed properly? Perhaps your son's future wife was supposed to give the embassy more information after her first interview but she believed she was denied and your son wasn't supposed to file a new petition.

But, as I stated before, it sounds like you do not have the full story... so it's all conjecture. 

Best bet is to request information from the embassy. I suggest your son call or email them to see if they can provide more guidance. 

ETA: there might have been an issue with her medical results which led to the cancellation...

No 221g given. Yes, he asked his attorney to email the embassy for more information. I’m only asking VJ community to see if anyone has had similar experience and could share it

No.  They do not mistakenly issue and then "cancel" visas because of a simple missing document.  If her medical was not complete at the time of the interview, they would have kept the passport and issued a 221g pending receiving the medical.

 

This is something much different.

 

Are you absolutely certain her divorce documents are authentic?  If she was petitioned before her divorce was final, and if they then tried to somehow conceal that fact, the petition should not have been approved.

 

You said in your OP that they told her they would hear from the embassy, so she can expect a letter.

You need to tell your story more clearly. Two K1’s refused, actually one approved and then revoked (fortunately without prejudice 🔑 ).

 

You either don’t have the whole information or you’re inadvertently (or otherwise) withholding some important detail. You need the actual reason for the denial otherwise she will simply be caught up in a vortex of spiraling denials and even after marriage the issue could still be material.

 

If it’s above your head as it appears to be, get a competent immigration attorney. In any case wait to hear from the embassy. There might be some clarification.

This is most likely the issue with both K-1 denials.  OP said something about the divorce dates on the visa application/petition not matching the date on the divorce decree, then later it was "fixed."  There could be more to this story as we are only getting things second or third hand.

Agree with the "getting married in Cambodia and a CR1 petition"

but from reading another post here i understand marriage in Cambodia is expensive so prepare for this with investigating the cost and procedure

 

If Cambodia approves the marriage application and the 2 are allowed to marry / that is if that country accepts the divorce degree and allows the marriage,  US accepts a marriage is bona fida when legal in the other country

 

you need to know why the embassy cancelled the K1 visa

and sometimes it is hard to get that answer 

Why is your son not here giving the VJ community the full background where we can see if there are any 'RED FLAG  issues"

I have seen one case where the consulate mistakenly placed 2 visas in a passport, then canceled the duplicate.  However, the CEAC status would indicate "Issued" if that was the case here.  I suggest waiting for a response to the attorney's email.  Please let us know what you find.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

so she was married to dude 1

she applied for k1 with the son

k1 was denied as divorce date didnt match. consulate probably thought that she was married to dude 1

divorce date fixed

in the mean time she applied for B1 to get to US - got rejected cause consulate  thought she was trying to circumvent K1 denial and immigrate and she had applied b1 visa before 

 

son applies for k1 again and now they rejected based on previous b1 cause they think she probably lied on B1 visa application.

 

is that correct  ?
