Proof of Relationship Affadavit - Notarized?

I am compiling all of the evidence to submit with my I-130 application for my wife, and I had a few questions:

-We have two friends who were witnesses at the marriage, they will be signing affidavits confirming this (as per the example in the VJ guide). Does this need to be notarized/certified in front of a some type of public notary? If yes, does it need to be a US public notary and/or an Apostille?

-Should the above letters + pictures of trips, texts, calls, a background of our relationship with an overview of all supporting evidence, be sufficient proof of marriage/relationship?

 

For the sake of clarity, our friends, as well as my wife live in the Netherlands, and I have since repatriated to the US.

this is mainly for when the I 130 is used to AOS someone already in the US and affadivits are done by people that reside here

as Affavidits are a legal document that can be used in court

they are useless when from a foreign country as  a US court can not enforce them

 

and really are not needed for a spouse visa 

just your marriage certificate and the English translation is all u need

its not that complicated for the Netherlands  as not high fraud

Thanks JeanneAdil. Just to confirm I understand you correct. You are saying that as my wife is a dutch resident, I should only need to provide the marriage certificate (issued in 4 languages, including english) as proof of my marriage as NL is a low fraud country? Is it a waste of time/paper to include the additional proof of the relationship (trips, texts, pictures etc)?

Ugg.  Affidavits from foreigners living abroad are acceptable but usually not necessary.  There is nothing to "enforce" references to enforcement are nonsense.

 

Other evidence definitely should be provided, but focus on evidence of time spent together.  Sounds like the US Citizen has "repatriated to the US" so most likely passport stamps etc. showing their time in the Netherlands with their spouse, and some photos, is all the additional evidence needed.

 

Skip the affidavits.  They don't help and CAN make you look desperate.

This is a discussion about filing USCIS and I-130 for spouse.  Context matters.  Affidavits from foreigners are as valid for relationship evidence as affidavits from US residents.  Both are usually worthless but the residence of the affiant is not an issue in THIS context.

 

Please stop with the irrelevant (in this context) nonsense.  It does not "help".
