The Canadian police certificate (requested under the Privacy Act) is good for a year and must include fingerprinting. If you go to your local police department, the officer might click the wrong type of certificate (e.g. for immigration purposes) as had happened to us on our first try. Go to your local Commissionaires office because you can choose the type of request in the online appointment form ("Fingerprinting - Privacy Act" ), which is automatically populated in the certificate request, https://commissionaires.ca/en/region/select. Booking online saves you a potentially lengthy conversation during the fingerprinting appointment. Ask the fingerprinter to include "RCMP National Repository Entire Holdings". Our certificate arrived approximately 10 days later.

Hello, this is a scanned copy of the Canadian police clearance certificate issued by the RCMP - under the privacy act. Depending on where you live, you could either get your fingerprinting done at the commissionaries or any other RCMP accredited fingerprinting agency. The type of criminal record check must say "Other (Provide Details)"

Ah, that's unfortunate. I just learned that the form changes depending on the region. If I select "Toronto / GTA, London, Barrie", it gives me the following booking form:

There are over a dozen options including a Digital Fingerprinting - Privacy Act option. Which region did you select to get the options in your screenshot?

Weird that they would differ from each other.. Maybe i should call them. Since Sudbury is closer for me i would prefer to go there instead of Toronto XD. Appreciate all your help btw

It would be a shame to drive that far just for a 10 minute fingerprinting appointment. Agreed, that if Sudbury can do it properly, it will save you a lot of time and expense.

After getting the wrong police certificate at the local police station, I decided to research what the whole Privacy Act thing means. As it turns out, most juvenile and dismissed charges do not appear in standard police reports because they cannot be considered in most situations for Canadian employment. By submitting a clean Privacy Act request to the US Consulate, it means that no records could be found in the broadest possible search including records that cannot be used in most Canadian situations.

The Privacy Act request exercises your personal right under Canadian law to obtain the full record including dismissed/juvenile records. The US authorities will use this information for adjudication under US law, but the Canadian authorities often cannot use it. This could explain why Canadian police clerks can be unfamiliar with Privacy Act requests as one would not need them for a Canadian job and requests for US immigration purposes probably represent a very small minority of appointments. Just make sure you do not get the "Reason for Request: Immigration" because this is not as comprehensive of a search as the Privacy Act request.

You can order this at an RCMP station, just make sure to request:

"Privacy Act Request" / "Criminal Record Check for Personal Use"
"Reason: Other (provide details)"

Not all stations will know what that is, so show the example posted earlier in the thread; it's the right one.

So for the "Reason: Other (provide detials)" do you have to provide details or do they just leave it blank. I received my criminal record check it was done wrong. They included my fingerprints and photo which i specifically asked for them not to.

In the Reason: Other (provide details)" section should the person doing the fingerprinting input (Do not include photo or fingerprints)?

FWIW I'm the USC petitioner, but I don't think you actually need to provide details; the wording should be exactly as I pasted it in the other comment. It sounds like they gave you the wrong type of check.

When you do this again, show them the scanned example taknev posted if the officers aren't aware what kind of check you're asking for: that's what the correct certificate looks like. It needs to be specifically the "Privacy Act Request" aka "Criminal Record Check for Personal Use". They'll take your fingerprints (but no photo), check them against the criminal database, then destroy them and mail you a certificate saying you're not in the database.

Sadly i did  show them the first time i had this done. Printed off the paper Taknev posted. Also had printed from the state.gov website exactly what needed to and not needed to be on the record check. I also went and drove 3 hour round trip to our "local" commissionaires office just to find out that the technician was off for that particular week so i had his/her secretary filling in and she also had no clue what i needed -_-. So back to police station i go hopefully they can get it right this time
