H2B confusion please help

Hello All,

 

My question is regarding visa fraud.

 

Our situation - We got married in May outside of the US and filed for immigration in May - Still in the I130 Phase. We reside outside the US.

Now however a great temporary job opportunity has been offered in the US with the possibility of becoming a permanent offer over time. It currently falls under the H2B program.

If I were to apply for the the H2B will it be fraudulent? It will be 9 month position and there after I will leave for my home country to have visa interview or adjust my status in the us at the end of my work time if the spousal visa hasn't come through. 

 

The big concern here is that we would like to go to the US but don't want to make any authorities unhappy.

Is this what you mean?  Yes, this is 100% fraud.
