Can immigration visa be applied in the 3rd country(not home country of spouse)

Timeline

I am the LPR of US, and my husband and children are Canadians. I filed I130 already. Once it gets approved, can I file the immigration visa at a US consulate in Mexico instead of Canada? Would that create any issues for approval? Thank you!

Do your husband and children have legal resident status in Mexico?

Why in the world would you want to go through Mexico they are well over 15 months wait from DQ to Interview.
You can only transfer their case to Mexico if they are legal residence of Mexico.
Are they legal residents of Canada?

Your husband and children visa category would be an F2A (family second preference category 2A) not an IR-1/CR-1 visa.  The wait times are quite long as there is a limit on how many F2A visa are issued each year.  They would need legal residency status in Mexico to apply from there.

In your previous post you stated that your husband is in the Canadian military and is in the US with a Nato-2 visa?

 

They cannot interview in Mexico if they are not residents there.

 

Also, your profile and timeline are confusing.  Your profile states the beneficiary is Ukrainian and you are going through CR1/IR1 (spouse of USC).  Your timeline states Armenia consulate and that your I-130 is already approved?

Sorry about the confusion. I was in a hurry putting in the timeline and that was a typo on Ukrainian. I130 was submitted and not approved. I am a total newbie on this website and need to figure out the right timeline answers..

They are Canadians. They don't want to take the vaccines/testing... thta's the reason they don't want to go back to Canada. Maybe they really have to if Mexico is not an option any more.

Is this in relation to all vaccines or just the COVID vaccine?

You are aware your family will have to get vaccinated if they want an immigrant visa.

Interviewing in Mexico will not change that requirement. 

I believe you can file a waiver but that will cost money and time. 

The second post refers to filing a waiver while in the States. But, as your partner will be interviewing in Canada, they'll have to file the waiver after the interview.

You do realize that the COVID vaccine is a requirement for them to be able to immigrate to the US, right?
