Hi there,

 

I am sending off my Adjustment of Status packet today and am pretty happy with everything included, and all triple checked. There's just one part I'm not sure about. 

 

So I as the non-citizen (applicant) for the AOS filled out the main form, however on the I-864 affidavit of support it asks the sponsor (my spouse) to fill out part 1. I'm not sure which box is needed to be checked by my US spouse for my petition?

 

As I am applying for the AOS, do they still need to check box 1a? As I originally came on the K1 petitioned by my spouse. Or is it a separate box?

 

Just want to get it right. Thank you in advance.

Yes, check 1a as your now spouse is the original petitioner of the I129F that allowed you to eventually get the K1 visa, and is now filing the I864 for their immediate relative to adjust status.

Thought that was the case but wasn't completely sure!

The entire i864 is to be filled out by the sponsor not just part 1. Of course you helping in filling out the form is no issue but if you are filling it in, think from your spouse's perspective.

It's still you spouse's petition not yours. You are simply filing for AOS thru that petition.

It's still you spouse's petition not yours. You are simply filing for AOS thru that petition.

Thank you, yes I am aware my spouse fills the whole i-864 out, I was just asking about that specific part.

 

In regards to the petition, thank you for the clarification 👍🏻.
