Okay, so we got an RFE for the I-864. My income last year was slightly under the threshold, but this year will be well over. I submitted paystubs for the entire year, I submitted a document that shows I get 42,000 salary. What else do I need to do to get them to realize I make enough? 

 

The only thing I couldn't submit was a letter from my employer because they only verify things via Fax. The only other thing i can think of is I had to cross out things on the household number because it auto fills, but I wrote in 3 for our household size. What am I doing wrong? 

 

I submitted a completely and full i-864

Three years of tax returns, last years was a little under, the previous two years were over. 

I submitted Paystubs up until October. 

I submitted a document from my payroll site showing my current income. 

 

What else are they wanting? I literally have no one to be a sponsor, I make more money than everyone else. The only other thing I know to do is add my mom as a household member and put her income on it, which is only about 14,000 but I don't know if that's going to make things worse. 

 

Please help... pretty scared right now.

That's weird. Tell your HR that you need it for immigration, and they don't take fax. They should be able to draft a letter stating: how much you make a year, and prospects for advancement at the least.

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

It's just a printout from KRONOS showing my salary. 

I downloaded the transcripts from IRS- but printed them out to send them. 

I'm trying to contact my employer again to ask them for the letter. 

I'm going to wait until I file the tax return for this year to resubmit the RFE, that's the only thing I know to do..

That could be your error that invalidated your otherwise good stuff.  They didn’t consider your income proofs because the form was done wrong. Do a new form.

Make sure what you write in “my current income” doesn’t exceed what you proved with your payroll document. 


Check your Part 5

#1. It auto fills 1 for the immigrant, your spouse. 
#2. Yourself. 1

#3. Blank because your spouse is counted in #1.

#4 or #5 is 1 for the other person you support and claim on your tax return.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

What I sent for my K1 packet (I know it's not AOS, but I will be sending similar documents for the AOS packet) was my offer letter on official company letterhead, my previous tax return/transcript that showed I made enough and a couple current paystubs.  If your company won't verify your job/salary officially, look into TheWorkNumber. Every job I've ever had...ever has shown up on my report and I believe they have immigration specific documents that can be requested right through the portal.

K1 process:

  • 12-08-2020 - NOA1 
  • 06-14-2021 - RFE 
  • 07-06-2021 - NOA2
  • 08-19-2021 - Arrived at Embassy

So with having to file our tax return paper this year, I don't think I'm going to have my tax return back in time to be able to send it on the RFE

 

So now at this point, do you think they will accept just my W-2, letter of employment, bank statements and pay stubs as proof of current income? Keeping in mind 2020 was a little under. Should I not send any tax returns at all this go around since I'm sending the one W-2? 

 

For my total income, do I go based on what is on my W-2 for last year, or what it will be this year based on the letter from my employer? I made a little over 38,000 for a family of three last year but will make 42,000 this year. I'm praying that's enough for them. 

 

It's so frustrating because I sent everything that showed my current income and I filled out everything correctly on the form, I claimed 3 for my household size which is my spouse, myself and my son.  Maybe I sent too many documents? I sent three years of tax returns plus the W-2's. Maybe if I make it more simple they will approve it? The ONLY thing I can think of that might not have been wrong is I put 42,000 as my current income, instead of what I had made to date when we sent in the form that would have caused them to kick it back. 

 

They didn't state that we had done anything wrong, just that my income wasn't sufficient and for 2020 it wasn't, so I get that part, but current is well over the threshold.

Current income based on your employment letter.

Yup. You shouldn’t have sent the tax returns plus the w2s. It’s either or. Easiest way is to download the transcripts straight from the IRS website

When you file a paper return, you don’t “get it back”. Maybe you mean a transcript won’t be created by the IRS in time. There are two different ways to submit your required tax return info written in the instructions for the I-864.

  1. A tax return transcript from the IRS.
  2. A complete tax return. That means a photocopy of every page in you tax return +PLUS+ a W2 or 1099 wage statement from your employer that verifies the income on that tax return you submitted.

Think about this…. You could fill out a fake tax return that says you earn $200,000 in salary, then print it, sign it and send to USCIS with the Affidavit of Support. Is there anyway they can know you faked it? YES. They have to have a wage statement (W2or 1099) showing  a salary in that range to make it complete.  If you don’t send both pieces of the complete tax return, it’s rejected.  But that is a totally valid way that you can include your 2022 tax  information with your RFE. Do #2 above. 
 

Don’t oversend extra junk like worksheets and stuff.  You are REQUIRED by immigration law to send a complete tax return (or transcript) with the I-864. What you said above…sending a W2 by itself will get rejected before they even look at your employer letter or pay stubs.
 

Include your 2021 tax return + W2 and you will qualify. The employer letter and pay stubs will prove you earn even more than the tax return Total Income line says. 
 

(I am struggling to remember this whole thread. Lots of really good information seems to have been deleted. Ugh!)

A family of three needs $27,450 to qualify. 

  • Your new 2021 tax return will show more than that on the Total Income line.
  • Your employer letter will show more than that and is your “current” income.
  • Your pay stubs will show more than that (multiplied out to a year)
  • your 2021 W2 will show more than that

Frankly you would qualify If you entered any of those amounts on the I-864 lines that say

7.  My current individual annual income is $____________

20. My current annual household income is $_____________

 

But don’t enter a penny more than is proven on paper (Anything from the bulleted list). Your actual current, right now, today income is what your employer letter says, so I would go with that on the I-864 #7 and 20.

 

And remember the I-864 page 5, #24a, 24b, 24c are copied straight off the tax return line for Total Income
24a.  2021 $__________
24b. 2020  $__________
24c. 2019  $__________
