Citizen Bring Mother to United States Legally

Timeline

My mother-in-law was in the US for 2 years illegally. She flew into Mexico, when they were letting people visit Mexico from Peru. Then stayed in Mexico for a few months. Then she entered illegally through Mexico to the US.Then she left US on her own accord and returned to Peru.  My problem in filing the I130 for her. Her visa was stamped when she left Peru to Mexico, it was not stamped when to left Mexico because she entered illegally in the US. When she returned to Peru, her visa was stamped upon departure from US and then stamped again at entry into Peru.  She has met the deadline of remaining in Peru over ten years. What problems do we face in getting her back  to US, this time legally

If truthful and not trying to hide anything - none. She is past 10 years out of the country. As long as she didn’t claim to be a citizen she’ll be fine.

Every thing is truth. But what about her passport stamps. do they matter?

Check the I-130 form instructions for that section -- answer only if the beneficiary is currently in the US.

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

 Overstays are different than illegal entry.  She snuck in so there is no forgiving that.  She has been out of the US for the length of her ban so there is no ban.  

This will not be over quickly. You will not enjoy this.

Since there is no ban, do I still have to say that she was here WI? Well I DID! I will Not Lie!  When she returned to Peru, they stamped her passport as re-enter to Peru via ATL, USA. Will this give her a problem when she goes to Consulate in Peru for Visa Processing? With that being said, I also have another question, I Put on the 0n-line app that she WAS here and in the Addition Information Part under the the Beneficial's Info part, since this is the only part to enter it, because out of all the options from the drop down menu, this was the ONLY option that made sense for additional information for her current situation. I explained here how she entered Legally into to Mexico as a visitor, stayed a couple of years in Mexico, then entered across the border illegally into the USA. 

When she left USA via ATL, GA, They DID NOT stamp her Passport. ( I don't know the reason) but they DID STAMP it when she Entered back to Peru.  I just don't want any problems with Peru when she goes to the Consulate in PER  to apply for her Visa or for that matter any problems with Mexico, since she did not return to Peru from Mexico but from USA. Does Mexico even keep a record of entering legally and leaving via the borderland, and not leaving legally through Mexico once you have entered.?  Or does Mexico not even come up in this process. I have not dealt with this kind of situation B4 because I'm not up-to-date with this on-in filing thing. Any help would be appreciate. Thank's in advance guys.

She sent me a copy of her passport and there are no stamps showing that she left USA from ATL , GA as I originally thought. Upon veiwing her Passport, I can not for the life of me find the stamp from USA to Peru. I just assumed that the USA had stamped it, but they DID NOT, which is very unusual I think. So my first post about them stamping it when she left USA is incorrect. They only stamped, when she returned to Peru. Beats me!

Not longer a DIY, imho. You’re dealing with borders and immigration from three different countries.

Thank you for your response, but as I see it, she only crossed one border illegally, Mexico/USA.  As I said she entered Mexica legally and left us Legally.  I don't see how that makes 3 borders.  Helpme to see that please. I appreciate your help

Well there wouldn't be, the US does not do exit stamps.

The circumstances for her entry from Peru into Mexico are completely irrelevant here.  US immigration only cares about her legal/illegal entries into the US.
