IR-1 IR-2 Stalling & Keeping Case Alive Techniques

You may recall that we decided to postpone moving to the U.S. for one year due to the extremely high costs of moving as planned in June 2022.  We are at NVC.  I have uploaded a few things but not submitted anything.  Now the plan is to finish the NVC submissions late 2022 or early 2023, dependent on how things are with visa processing at that time.

 

How to keep your case(s) open has been mentioned in many threads.  Generally speaking, you need activity at least once a year, it seems.  We received the NVC Welcome letters in February 2021.

 

I'm wondering if any members have recent actual experience in delaying their cases at NVC, for whatever reason, for and how they did it.

 

Options?

 

--  Login to https://ceac.state.gov/IV/Login.aspx every month or two

-- Delete a document.  Upload a document

-- Call them once in a while and explain, and they will note it in your file?

BUT i say send in the NVC submissions and be ready to do IRS tax returns for 2021 early (and perhaps a new I 864 when notified of the interview)

You can delay the case as the site says for 1 year EVEN,  after the documents are submitted 

send them to make sure they are accepted and approved 

you can delay if u want  but the queue is long to begin with

delay if u wish by not paying the fees and sending documents 

and check the Philippines site for timelines to see how long people are in NVC waiting after DQ/  i am only guessing from ready posts here but i would say a year in queue at NVC

My 2021 tax return is simple.  I am retired and have control of my income, so just this last week, I created taxable income to that I have a healthy 2021 income for the I-864.  I had finished the I-864 with current data, and yes, I will need to revise it later.

I have been monitoring DQ to interview times for USEM Manila.  Not too bad.  Usually only 1-3 months.

This sounds good, for peace of mind of being DQ earlier.  So then my question is, what are techniques to delay after DQ?  Call them?

 

Using this method, I might submit everything (ds 260, I-864, supporting docs) mid-year 2022 and be DQ by Q4 2022.  We want to leave Philippines June 2023.

Planning on leaving June 2023 ,  u are asking NVC to delay the interview too long

the medical for a june visa expiration would have to be done in January 2023 as the visa expires 6 months from the medical exam

you can only delay NVC AOS and ds 260 documents a year 

 

NVC recd your case 2/25/2021 so the year will be up in February 2022

I would file all and cancel (if needed)

Can you delay visa interview?
 
You may only schedule a new visa interview appointment if you missed your previously scheduled immigrant visa interview appointment. If you schedule a visa interview appointment before the date of your initial immigrant visa interview appointment or meet any of the conditions below, you will not be interviewed.
 
Keep in mind the queue is long for Philippines and u may be waiting (in your needed timeframe) just to get the interview

A buddy of mine was DQ'ed in 2020 and had to interview in Feb 2021 because if they didn't they'd have to refile again. (or at least that's what he told me)..

He DCF'ed so I don't know if that changes anything... but they extended their leaving time to July 2021 (just before the medical expired). 

There is always the idea of flying to Guam or your closest US State to "activate" the visa and then returning to the Philippines to extend the date of your move. But, I don't know if you can delay this visa petition until June 2023... maybe more seasoned members know how to reacivate a visa (as I believe 1-130s don'ts expire) but you'll have to file a form and repay NVC fees.

I noticed afterward that Payxibka has not visited since August.  I hope he is OK.  Very knowledgeable.

 

I considered entering the U.S.A. to activate the visas, and then returning.  However, we are living in the Philippines as a family and I don't know how I could claim "intent to re-establish domicile" and do that.

 

Someone just posted about Manila Embassy timelines.  Generally speaking, it is only 2 months from DQ to interview for IR visas.

Update:  We submitted the DS 260s on the 4th of February, 2022.  We received the message below from NVC on the 14th.  So now I will start trickling the documents in.

 

NVC cannot review your submitted documents until we have received all of the required documents DS-260, Civil Documents and Financial Documents. Once these documents have been submitted, we will review your case. Please follow your CEAC Home page and https://nvc.state.gov.
