To me, it sounds like either they found something during the extended AP or they just declined to extend the case any longer.  If you and your fiance are committed to each other, then I would ask my Senator to make an inquiry (which may or may not be productive) or just marry and start the CR-1 process.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Did your partner tell you what happened at the interview?

Does he remember the questions they asked and what they said at the end of the interview?

Did he receive a 221g paper with anything checked off? 

Did they request any additional paperwork at the end of the interview and did you provide it?

Sounds like there were red flags in this case.  OP, generally beneficiaries know what the reason is, based on the content of the interview.

Would be good to find out what the issue was, so you can make sure that same issue won't get your future petition and/or visa denied as well. 

 

Your need to ask your spouse about what the issue could potentially be, s/he needs to be honest with you and tell you everything that was asked and talked about at the interview. If there was something specific the CO kept asking about, then it's possible that is the issue.

Yep.  This is a tough one.  It appears, to me, that the case entered extended AP and subsequently expired.  It could be a significant issue discovered during that AP, or the consulate could have just decided to let the case expire to help clear their backlog.  Jim Hacking has reported that some consulates are doing that......

I think this is a tactic used also  by USCIS and NVC

as my case was well over 16 months in USCIS and over a year at NVC (made me do the I 864 over and over as they didn't want to accept my untaxable income 

even thought i had SSA and 2 retirements that alone were more than enough)

 

Even the NOID itself,  fighting this is not easy/ for me i had put all info on a USB and good thing i did as my laptop died during the process

 

i believe they think people will just give up and i know of 3 couples that did 

i am sure there are many others who just can't afford to go further in the process with more visits ,and/or a lawyer plus the hardship of being apart 

it wears on people

As fare as we know the interview went well , he was missing one document so they gave him the 221g paper , once he brought the missing documents , the consulate told him he was approved , they even told him  to go and pick up his passport with the visa the following week, and then nothing up until today ,  the never told us why they didn’t sent the passport or asked for more documents , 

every time I would call they gave me an excuse about the pandemic and the political situation in Haiti for me to be patient,  

that is why I am so upset, they waisted 2.5 years of my time only to do this😡😡😡😡

I went thru EXACTLY the same scenario. The ONLY way to trace your pending application, to know the exact reasons why it was sent to USCIS, and to get application to be moving is- get your congressperson to be involved. Within a week petitioner would know the answers to all this questions. When I (petitioner) approached my Congressperson’s officer and filed the inquiry status thru them, it took them only a week to find out where my case is sitting and why and then all of sudden it started working ….However, I totally agree with Crazy Cat that there must be some complications in your pending application which makes US Embassy to have sent it to USCIS. In my case there were many red-flags, and case sent back to USCIS to investigate those matters thru their field office’s fraud department. If you wanna avoid all this then you may choose to file CR-1 case but no guarantee it will not cause the same result. I had IR-1 case. I chose to deal with those issues than just moving on…..Besides, I couldn’t have filed any other case anyway because the case was for IR-1 visa. Again, there were many-many red-flags in my case.

Hello 

At that did they collect any document from him ? Cause I was  told the same thing that they are going to send the case back and to call uscis . I’ve been trying to get  an explanation for like a weeek . Nothing solid yet so I gave up . I’m jut going the spousal visa route instead of waiting.

The ambassy returned all the documents that we gave them, with a letter stating “we don’t have space for storage of document, 

although the form has a space that could indicate rejection of my visa application it was not checked, or did they stamp a refusal on the passport , the case is now back at USCIS

 

I don’t know what they are doing , this whole process is confusing
