Timeline

Hi

 

my fiancé case status was changed from expired to administrative processing on 4/1  and on 4/8 is see that the status says fill is getting transferred to another us consulate office,  Are they sending the case back to US or working on given a visa, they still have the passport and didn’t try to contact us since June 2021

Hi, my case was in AP since 2019 then changed to expired  and I received an email earlier saying the same thing.

There definitely something they are “ looking at” here. Only your fiancé would know if there could be anything that may have raised red flags. 

At most you should try reaching out to your Congressmen/Senator as recommended. Google it, download their Authorization form and call them for help in getting a decision. 
 

If that doesn’t work, then filing a lawsuit ( ref to as Writ of Mandamus ) will force a decision..good or bad.


If you are in for the long run, then consider marrying your fiancé and do an I-130 .

 After my fiancée waited almost 2 years for a decision on our k 1 visa application , the US ambassy I. Haiti . Sent the case back to USCIS and returned the passport , I called the ambassy they told me to contact the USCIS  . The application process has been going on since 2019. I still don’t have an answer , I am so discouraged this was supposed to be a 9 months process,

 

has anyone case been returned to USCIs and still get. A K1 visa approved ? 💔🥲

Timeline

NVC has returned petitions when they find an administrative error.  Those petitions are normally sent back to NVC to continue the process.  However, when the consulate sends a petition back to USCIS, it almost always expires there and dies.  Based on your previous posts, it appears the consulate chose to let the case expire rather than extending it.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you hear anything from USCIS (which is doubtful), it will takes 6 months.  Even then, they will probably just tell you it expired. If you and your fiance want to continue the immigration process, I think your best bet is to marry and start the spousal visa process.  Be aware that marriage does not cure all K-1 issues.......as it appears your case has some sort of complications.

Once a K-1 case has been returned to USCIS, there is no appeal, no rebuttal.

Is there any way to find out what the complications are , I don’t have any answers from them except they keep telling me to wait, which is not fair , 3 years is a long time for one case which they knew they were not going to approve

The interview was in December 2020?
