Do I have to wait till I complete AOS to work? K1 VISA applicant but I already have my SSN already from when I was a student (F1 Visa)

Hi All!

I'm currently going through the K1 Visa process, I've been approved and already I have my interview next month. I will likely be moving to the US in the spring if all goes with at my interview.

I was curious if I would be able to work right away after receiving my marriage certificate and before applying for AOS.

 

I received my social security number when I was a student on F1 Visa that has the legend "Valid to Work Only with DHS Authorization". (see attachment for example)

Does the process change for me? What do I have to do to remove the "Valid to Work Only with DHS Authorization" condition on my SSN?

 

I'm just trying to prepare myself before I move so I can complete all the correct paperwork and do it efficiently for myself.

Timeline

The EAD is the work authorisatiion to go with your card.

 

You just keep the SSN you were given.

 

So marry file to adjust including EAD and AP as soon as you can after entering.

When you get your GC then you can get an unrestricted EAD.

 

Well not sure I understand your last sentence, EAD normally comes before GC Interview so the EAD and SSN will be what an Employer needs to show that you are work authroised. Anyway that is a long way away.

once you get green card, you go to SSN office and show your green card, ask for a new social security card due to status change. your new card will not have restrictions

No, you won't be able to work immediately after applying for AOS. You will need to apply for EAD, which is currently taking around 9 months. 

Once you get your greencard approved, you need to get an appointment at the local SSA, and they will issue a new unrestriced card (same number). But that's a long way from now!

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

A drawback to doing a K-1 (vs CR-1) is that you cannot work or travel until you have EAD/AP.  Those are currently taking around 8 months to receive.

Stems to the fact that not many people do their due diligence and researched on their options and its pros and cons before embarking in the process.
