Help! Still using ex-husband name

Timeline

I was annulled 4years ago but still using my ex-husband surname in all of my legal documents. Me and my fiance is planning of applying for K1 visa. We met here in Japan and our relationship is already 3yrs. He will be returning to the US for a new job. And he wants me to be in the US asap and get married there. My worries is that im still using my ex-husband surname. Will it be a problem if i use it in applying k1? Or should i change my passport and other ids to my maiden name?

This should not impact anything related to immigration.  My now wife was still using her ex’s family name when we went through the K1. Just make sure to properly list all previous names used.

No.  Names are not owned by specific people.  Your name is your name, unless you choose to legally change it.

Thank you so much for this info. We will fill-in the k1 form this week. We started preparing both parties infos since He is now in the US and I'm in Japan.

Timeline

many people (both in the US and abroad) keep their married name after a divorce. As long as you have a divorce decree, you can go by whatever name is on everything. Make sure you list your maiden name in previously used names

 

i was SO happy to lose my (ex husbands) last name LOLOLOL

i 485, 130, EAD and AP

04/09/2019    NOA1 received/check cashed i 485 and 130 (direct adjustment)

11/7/2019      Interview- Norfolk

11/10/2019    APPROVED (notification rec'd 11/10, approval dated 11/8)

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.
