I-485 / I-864 RFE Questions

Timeline

Got an RFE on my husband's submitted I-485, specifically the I-864 that I submitted. I am the USC, he is the immigrant. I am sole sponsor, make well over poverty and have for 11+ years with same employer. Filled out I-864 completely, current form as of 3/10/21. Form is signed, includes my SSN, lists 2 as the number in our household, and included 3 years of IRS transcripts, 3 years of W-2s, letter from bank, letter from employer, balance statement of 401(k). We got the attached RFE today and I am totally confused as we submitted all of this, and, I scanned the entire packet before we sent it so I have an actual PDF of exactly what was sent so I know what we sent. Any suggestions? What am I missing here? I know this one is a big deal so I do not want to get it wrong.

What did you provide for the evidences of current annual income? Tax transcripts, bank statements, 401k are not thr evidences of currnt income.

 

Don't confuse them by providing unnecessary documents like banks statements, 401k, W2 n such if you are earning well over the limit and have tax transcripts.

Letter from employer confirming full time employment with salary along with pay stubs for six months. Neither of which they ask for in their RFE so I did not list them in my question above.

This is the exact same RFE we received. Similarly to you, I make well over the income guidelines and had completed the document and given the relevant info upon our concurrent filing. We did not include W2s but had given the tax transcripts, a letter from my employer, 6 months of pay stubs.

 

Just do everything the letter says. I uploaded all requested info within a few hours of receiving the RFE, and the status was updated soon after.

From the letter you posted, they want the full IRS tax return for some reason, plus all supporting schedules and documents, for 2020.  Double check the I-864 and make any necessary corrections, then send everything again plus the 2020 tax return and documentation in response to the RFE.  Good luck!

To me, and like an above commentor said, you submitted alot of useless documents which they have literally thrown up the the air and said ftw and asked you to start over because they do not understand what you are trying to show them.

Provide exactly what the RFE says.

Do not add extra stuff with the I864. If income meets the FPGLs in Part 6 Q7 only submit THAT document that proves it.

Plenty of unnecessary documents here.

Just follow the RFE to the T. Nothing more, nothing less. No need to send 3 years of w2s, or letter from the bank, or balance statement. 

Just one year of the most recent tax return with supporting documents and IF YOU WANT a letter from employer and recent paystubs. That's all.

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

I mean, within the progress report threads from a VJ member for each month, all those documents are optional to attach. And from a newbie perspective, frontloading a petition with more evidence in the beginning is always going to seem like a better idea than not including them.

I guess it's different perspectives, which is totally fine. I've been dealing with USCIS long enough to know that if you send them too many unrequested documents, there is a high chance that you will get a RFE
Regardless, nowhere that I know of does it say that it is optional to send bank statements and 401k statements if you are not relying on assets. I think that's what threw them off.

I remember sending a letter from a banking officer for the K1 and my retirement accounts info as well. Not sure if that was also an optional attachment, but I digress.
