F2A: Travelling to US with spouse while case is at NVC

Hi everyone.

 

My spouse and I have been DQ'd for several months and are just waiting for our interview (F2A). I'm a green card holder and live in the US, while making occasional visits to my spouse in Canada. I'm planning on driving to Canada during the holidays for a few days and then my spouse and I are going to fly to the US for a 2.5 week vacation together. I'm wondering if this is okay and if we should expect any issues from customs. She lives and works in Canada and also has a return ticket home. The last thing we want to do is jeopardize our case in any way, so we would really appreciate any feedback.

Just make sure your wife has evidence of strong ties to Canada - the return ticket, a lease agreement/mortgage statement, letter of employment - to prove she is returning.  She may or may not get asked for it, but better to be able to provide proof than not.

Thank you for the reply, I really appreciate it! She does have a return ticket and can show proof of employment as well, but not a lease/mortgage statement as she lives with her parents. Hopefully that will be sufficient enough if requested.


Is there a risk of them turning her away or barring her from entering the country for any reason? I’m only asking because I’ve heard of third-hand stories of officials suspecting a person of trying to permanently stay in the country and banning them from entering for a 5 year period. Admittedly, I don’t have the full information on that or what the situation was. I just heard it from someone who heard it from someone else. I might be over-worrying for no reason but I’d just rather be extra prepared. I wonder if they already have our case information on hand. If anyone has any first-hand experience with their spouse visiting, it would be great if you could share your experience.

Does she have a vehicle loan? Maybe the insurance for it, bank accounts or something else tying her to Canada?  That’s all they are interested in. 
 

Typically, if she’s not going to be allowed in, she’ll find out right away. I don’t think you have much to worry about if you’ve been visiting off and on for a while. Status quo so to speak.

It’s been just me visiting her. She hasn’t been to the US since we started this process. And yeah, we’ll bring the return ticket, proof of employment, bank account information, auto insurance, as well as anything else we can think of, and hope for the best. Hopefully everything goes well. Thanks again for your reply!

No problem!  There are a lot of people that have gone south after approval.  As long as you have proof you're coming back, it's fine.  Hubs usually visited us when we were going through the I-130 process but we did head south on an occasion or 2 and never had any issues.
