Turist/student visa

Me and fiance started our k1 visa journey. I was wondering can he apply for turist or student visa while we are waiting for our K1 visa? We will not get married. I cannot visit him due to my work so he would like to visit me.

Sure, he can apply.  However, proving non-immigrant intent will be the obstacle.

He can apply but it's unlikely to be successful.

 

A.  A tourist visa requires non-immigrant intent and that will be hard to overcome with a pending K-1.

 

B.  A student visa requires that he be admitted to a university.  He has to show that he has the $$$$ for school which is about $20,000 to $40,000 a year for an international student, and wait until the next semester which is Fall 2022.  He will also need to show his non-immigrant intent by showing a foreign home that he intends to return to after finishing his degree.  With a pending K-1, it's going to be hard to show that he intends to go home.

To be honest, the Consulate Officer might think this is just an attempt to usurp the K-1 queue......an attempt just to get inside the US.  Visiting each other somewhere outside the US might be easier.

Not might.  The CO is completely familiar with this tactic to avoid the K-1 wait.

The OP is completely unaware of the timeline to get a student visa, so if it looks like a duck, . . . it's a duck.  

This is a case of is there any visa that he can get so we can avoid the separation of waiting for a K-1?

I understand the desire not to be separated, but the CO is not going to allow this.  Sorry.

It certainly could be interpreted that way.   A tourist visa and a student visa have completely different purposes, but one common element.....both grant an applicant entry into the US.

If you live close enough to the Mexican border, you can get global pass and apartment in Mexico and commute to work, maintaining your residence and job on the US side. It is actually easier and safer than most people think. We waited the entire K-1 process like that. You just need to make sure he returns to his country 1 month before the interview to allow sufficient time for medical and interview prep. You can order police certificate distantly arriving to your fiancé’s home country address.
