Adding additional documents after submitting

Hi there,

Hoping someone in this group can help me.

We've been through a few different RFEs at the NVC stage. The latest was in September, where they asked for a joint sponsor birth certificate and my W2 for 2020. We submitted the birth certificate on September 3rd, however I thought the request for the W2 was potentially a mistake as my AOS documents have been "accepted" and my 2020 income was foreign earned (so I don't have a W2). I've seen a few instances here where people have been asked for this, and have submitted a letter explaining that the income was foreign earned and no W2 was available.

My question is - if we submit a letter now explaining why I don't have a W2, are we going to be put to the end of the line and have to wait another 3 months?

Thanks so much in advance!

Officially each time you add a document and hit submit you go back to the end of queue and that date is your new submission date.

But we have some anecdotal reports here of about three people who have added documents BEFORE being reviewed and maintaining their review submission date.

If you have been requested to provide a W2, and have not done so and have not provided an explanation of why you don't have one I suspect they will RFE you again. I would recommend you add a signed statement explaining why you don't have a W2 for the requested tax year.

Thank you! They sent another request asking again for the W2. We've submitted the letter now - back to the end of the queue we go :(

There is no exact science to that.

Two days ago someone was asked for W2s also (even though they submitted IRS transcripts) and they were approved next day.

So, good luck to you also to get a speedy re-review
