She can spend time with you using ESTA. 30-40 days is more than enough time. 

If she wants to find a work visa for the US she should search for a job from Germany. 

People usually arrange everything while living in their country. They don't travel to the States and find a job and then apply for the work visa.

Not to be blunt but her talking to companies without telling them right off the bat that she needs sponsorship only wastes their time.

Then she also needs to be aware if the employer is able to sponsor or it wastes her time. It goes both ways. Perhaps go directly to HR and ask first, other workers in the company probably have no clue about visas or sponsorship. Getting a work visa is a whole other topic and I suggest she make an account on here and post under Work Visas if she's looking for advice about it.

I never said it was suspicious. I said she has to convince the immigration officer (who is assuming she wants to overstay as that is how they treat all applicants, it's their job) why she should be given a B visa. Explaining why ESTA's 90 days is not enough is part of that explanation. It is fairly straightforward and it's all about showing strong ties and reasons for her to return back to Germany, as that is the main thing they're looking for.

shaynethekid's GF: I have an American boyfriend in the US and I want to be with him.

Interviewer: Are you going to marry him?

She doesn't need to be here to interview for jobs which she could be sponsored for......2021, and COVID.....I'm sure you realize such interviews are typically done via Zoom.

Do you know that it can be risky to try for a B visa when one is eligible for VWP? If the B is denied, the ESTA option goes away.

 

Not that people haven't done this successfully (my husband included), but it is generally not recommended here on VJ.  If I knew then what I know now, we wouldn't have risked it.

And what are her reasons for leaving and returning to Germany? Does she have any ties there that are stronger than a US boyfriend? This is the name of the game with B visas: weighing up ties to the US versus her ties to her home country. It's what the officers are trained to look for.

Most adults with legitimate visitor intentions simply do not have 6 month periods free to be away from work and other responsibilities.   So the scenario you are describing will raise questions with both the consulate and CBP, IMHO.

This comment shows your lack of knowledge about the H1B work visa process.  You should encourage your GF to join VJ and read and research as much as possible about all of this.  It is complex, and you need to educate yourselves to avoid pitfalls.

Might be wrong here but as far as I know  the company decide to sponsor you, have all the labor certificates needed etc. You or the company (not sure) registers for the visa and then USCIS randomly choose 65K applicants + the cap exempt  ones and notifies you to submit the full package if u were selected. Even with a job offer there is no guarantee that you will be selected to even submit your package.

shaynethekid's GF: I am taking a sabbatical from my job. 

Interviewer: So, you don't have a job?

shaynethekid's GF: . . . 

Interviewer: Where do you live?

shaynethekid's GF: I rent an apartment.

Interviewer: How can you afford to pay for an empty apartment for 6 months when you are not working? You are not allowed to work during your stay in the USA.
