I mean the thing is you can't send what you don't have. You can only try to explain and hope for the best. Don't focus that it wasn't him who filled out the application cause USCIS don't care. The pope could have filled it out for him but he was the one signing and swearing he's telling the truth so it's on him.

If he entered and overstayed without leaving the US you didn't need a waiver.

So it seems that the beneficiary overstayed and never left the US and the petitioner is an LPR not a US citizen, therefore the need for the waiver.

So your lawyer said you needed to file a waiver? Why? Are you a USC? If so overstays are forgiven. No need for a waiver. Plus he came inspected anyway so unless a CO told you you are eligible for a waiver you don;t pay and file for one.
