Hi,

My employer A  EB2 I - 140(priority date -2012) was revoked by uscis due to ability pay.Moved to Employer B in 2013 apllied new I 1-40 in EB2. Got approved . But  in
the approval notice they printed my employer A revoked I -140 priority date(2012).I raised this issue after getting the approval itself.But My attorney told that it is a 
uscis mistake and we can  correct it at the time of I -485 filling. 

 

As EB3 became current, I downgrade from EB2- EB3 and applioed I -485  with new priority date for safer side. In EB3 got approved, uscis issued correct priority date(2013). I asked the attroney to look back to EB2 filing.
In EB2 filing, retention of old priority date was requested from attorney.I came to know it is not a uscis mistake.

I need to corredt this in my EB2 I 140 .

 

It is almost 7 years over. May I know what are all the possible options to correct this.

 

Any suggestion please.

So what's the issue? Your latest/current EB3 has the correct PD. Why are you going after old EB2 that's no longer active?

2017-08-01: Entry to US

we can not say EB2 is not active. I already Filed my  I -485 under EB3. The EB3  dates are retrogressed. As EB2   is moving forward  I can  interfile  and ask uscis to use  eb2  when it is current. So I need to correct this date ...
