An approved I-130 petition doesn't expire.  That is USCIS.

 

Look at CEAC and make sure the petition is still at the consulate.   File and pay for an updated DS-260.  Then contact the consulate and schedule the interview.  Do the medical in time for the interview.   Make sure all of the support documents are on hand for the interview.  The petitioner should also send and updated I-864 to the beneficiary to take to the interview.

She doesn't need to travel to Ghana for that. Visa application is your process not hers. All you need to do is call the embassy to start DS260. She simply needs to provide or upload the documents to ceac one ds260 is started.

 

Ask the embassy if i130 is still active or they have recommended it for revocation. Sometimes the embassy might ask for i130 revocation depending on the case. If they have not asked for the revocation, you can go with new ds260.

How many times have you been together, in person, over the last 3 years?  Has your USC wife visited you in Ghana during that time?  Based on previous cases from Ghana that sometimes take years, I would recommend that you see each other one or more times prior to filing another I-130 (if necessary), or a new DS-260 and upload the evidence of those visits to the CEAC site.  For sure take evidence of time spent together since 2018 to the eventual spousal visa interview in Ghana, which could be in 2022 or maybe 2023.  You don't want to go into a visa interview and have to answer the question, "how many times have you been together, in person, since the previous visa denial?" and you answer "none," as that would call into question the bona fide nature of the marriage relationship.  Good luck!

That’s makes sense… ever since the denial we hadn’t been together. She’s been to Ghana for ones. Due to some financial constraint she hasn’t been able to come. We are now arranging she comes for the second time. You think it’s necessary she comes back again right?

You have not seen her during the 3 years?

 

Sounds like a green card marriage, honestly.  I think you're looking at more than just the public charge issue.

Ooo we’ve been married for many years now and the reasons as to why she’s not been able to come here is for the fact that, she lost her job and home. So for a year and two she was actually struggling to find a job. Now that she has found one is why I and her are working on her coming to Ghana again. It has been her choice to come back & fro.

Ooo we’ve been married for many years now and the reasons as to why she’s not been able to come here is for the fact that, she lost her job and home. All I can say, is expect scrutiny.  Ghana is a high-fraud country, and this fits right in.

Doesn't matter - you are basically starting over, and you will have a new interview, and the validity of your relationship will be considered.
